一旦485杯具，是不是从用ead卡那天开始就算out of status? 还是从485被据的那天
开始算？
如果是前一种情况，485杯具，485 pending 超过180天或者用ead卡超过180天，那就非
法超过180天，岂不是面临3－10年不能进入美国？
如果是后一种情况，那还能立即再转成h1b或是其他身份留在美国吗？
我有这个疑问是因为，和ld现在都是h1b, 140批了，一起交485，不知什么时候才能拿
到绿卡， 在考虑其中一个用ead的风险。
请教大虾。多谢。 |

发帖数: 176 | 4 如果夫妻只有一个人用了EAD卡，另一个人还是H1的话，如果485被据，还是可以转回到
H4吧，只是不能再转回H1了。不确定是否正确，只是印象中好像是这样的。请知道确切
信息的人指正。

发帖数: 1183 | 5 我没有找到原法律条文来支持，但读了众多中文英文的讨论和说明，印象是，
只要通过正确的程序申请调整身份比如交485，移民局也接受了案子，pending期间不算
进illegal status，illegal 从杯具那天算起，再加上以前的，如果有的话。
原h1能转成h4, 如果配偶保持h1身份。 因为h1可以允许移民倾向。这个和f身份不一样。
也能再转成h1. 但不清楚能不能在境内转。 有律师建议用ead卡，因为可以节省h1b 6
年的时间。
结论是，h身份用ead卡， 风险其实不大。

发帖数: 1065 | 6 pending期间是合法身份。如果用ead，485被拒必须立刻离境。如果LD H1，可回国签H4
，如果有公司还愿意sponsor h1b，并且满足申请h1b条件，则可回国签H1。
我也认为用ead的风险不太大，但不是楼上的原因，而是485在收到AP/EAD后被拒的可能
不大。 |

.
If that happens, you may file for MTO and they will likely to keep EAD valid
. Or you can refile 485, if you feel the new 485 is approvable.
Or you can ask your employer to file H1 with PP. Once it's approved, leave
the country and come back as H1B non-immigrant.

2) Illegal is only when your 485 is denied.
It is the same as when you have 485 pending, and you have none of valid H/F
visa, you can still legally stay in US.
3) after 485 denied, you have to leave US to get another visa H1/H4 to get
back to US; F visa then is not available, since you have applied for 485. |

发帖数: 836 | 10 You are mistaken LCA wage and PERM PWD. LCA wage is determined within state
and takes a week. In case you don't get it in a week, you can use the '
prevailing wage level' within your company with justification.
Either way I don't think you can do COS from AOS to H1 within the US. You
need to go out of the country and come back with a valid I94.

One lawyer says, if 485 rejected and h1b six-year limit is reached, then h1b
can not be extended any more, accordingly the applicant can not stay in the
States either. That is why he said using of EAD card could save some h1b
time. |
