True concurrent filing (i.e. including the I-140 and AOS in the same package
) is not recommended for EB3 China downgrade cases. USCIS has been
inconsistent with respect to accepting the EB3 downgrade petition under
premium process without the original PERM Labor Certification. The most
recent EB3 China downgrade filed by our team was rejected by the premium
processing unit and we are waiting to see whether it was accepted under
regular processing .
The recommended approach is to file the I-140 stand-alone via premium
process, then file the AOS after USCIS approves the I-140. If USCIS does
not accept the I-140 via premium process due to the lack of original PERM
Labor Certifications and instead places the petition in the regular
processing queue, then we have the option to file the AOS using the I-140
Receipt Notice and try to convert the I-140 to premium process.

和律师fight了很久，要求concurrent filing，律师不同意
吵到HR那里都不行
后来乖乖的先140再485
过了一个月，同事降级
同一个律师，主动问他是否要concurrent filing
完全搞不懂fragomen是怎么回事
只能说尽人事，听天命 |

比较保险，485不会退件，跟他Argue没用，我也从了。
