另外律师关于以"New" file比按照"amended" file要麻烦少一点，这个跟置顶FAQ里的
信息基本一致，虽然“amended”也有成功降级并绿的。

Firstly, you can't normally file premium processing on an I-140 that is not
filed with an original labor cert. The reason for this is that USCIS has to
submit a formal request to the DOL for a certified copy of the labor
certification and that always takes longer than 4 weeks. We can try to
submit a request to premium process after that, but the USCIS will only
accept the I-907 after the DOL response has been received. I have no control
over when that happens.
Secondly, you will want to file a "new" I-140 petition, not amended. If you
file amended then you are asking to modify the prior petition. My
understanding is that you want to preserve both, correct? If so, we don't
want to alter the prior I-140 in any way. Plus, there are issues with
amending that I would like to avoid. |
