发帖数: 32 | 1 这个问题有点复杂：在美国境外期间，绿卡批了。去年递交i485的时候，小孩还未出生
，后来计划年底回美的时候，再给孩子递交i485，境内调整身份，没想到比预期提前拿
到绿卡。
现在问题来了，孩子无法进入美国境内，本来律师说可以申请baby transportation
letter, 结果大使馆说由于孩子出生后才拿到绿卡，所以不行，可以拿h4入境，可实际
上，拿到绿卡后，我的理解H4就失效了，那现在小孩以什么签证进入美国呢？感谢提供

有没有问过 CBP Local Office，看看他们有什么建议。

师去问了，还没答复，之前就是他们说transportation letter是可以的，结果大使馆
说不行

看看 Following-to-Join Benefits 部分，再问问律师和US Consulate。
If you were married and/or had children who did not obtain permanent
residence at the same time you did, they may be eligible for follow-to-join
benefits. This means that you do not have to submit a separate Form I-130
for your spouse and/or children. In addition, your spouse and/or children
will not have to wait any extra time for a visa number to become available.
In this case, you may simply notify a U.S. consulate that you are a
permanent resident so that your spouse and/or children can apply for an
immigrant visa.

这么小的baby都不用面试。
不要相信律师，尤其是移民律师，大部分就是骗钱混饭吃的。是律师中的渣渣才作移民
这一项的。
