期H1B，然后等排期，不知是否来得及。因为申请绿卡必须在H1B结束之前至少一年是吧？
听说H1B期间回国的时间可以用来延长H1B的六年限制，请问这个政策是否确实？如何操作？
我在国内待了7个月左右，如果加上这7个月，应该就来得及在H1B结束前一年提出绿卡
申请了。
版上的xdjm有没有人办过类似的H1B延期+绿卡申请？难度怎么样？

you can't extend your H1b beyond six years if you didn't file your GC before
the end of your H1b's fifth year. Your H1b will be automatically terminated
by the end of sixth year.

发帖数: 117 | 3 I switched employer when I have been in H1B for 4.5 years in July 2008. My
employer file the PERM labor certification in April 2009 and it was approved
in around Mar 2010, they PPed my 140 which was approved in the same month.
My three year extension of H1B was filed very soon after that and got
approved in July 2010. Now I have been in H1B status for 7.5 years.
You can extend your H1B annually beyond the 6-year cap if your PERM has been
filed for more than one year and it is still pending, or
You can extend your H1B for three more years if your 140 has been approved.
If you have to go through PERM, I would suggest that you find an employer
who is willing to initiate the PERM process (it takes some days for the ads)
as soon as you start. You don't have the luxury of wasting time if going
through this approach. Or
If you can file an EB1B with sponsorship of your employer, then you have
plenty of time if you PP your 140 and it gets approved. It is even very
possible that you get your green card before you exhaust your 6-year cap.

It is true based on my communication with the attorney assigned by my
employer, but my case ended up not having to use this policy. My personal
thought is that you can apply H1B for the time length while you were not in
the States before your current H1B expires, if you can provide proof that
you were out of the States for that time length. |
