所以在考虑申请NIW,然后用NIW的申请作为理由申请在新公司的H1B的extension。
请问，这样申请H1B延期可行吗。
如果这样可行，是不是NIW的申请一旦递交上去，就可以申请H1B的extension?

maximum 6 years of authorized stay; 3 years each time.
(2) If I140 has not been processed, your H1b can be extended (1 yr each time
) ONLY IF "365 DAYS or more have passed since the filing of a Labor
Certification application, Form ETA -750, or 365 DAYS or more have passed
since the filing of the EB immigrant petition I-140" - you absolutely CAN
NOT submit the H1b extension immediately after filing the I140 case.
NIW is in EB2 category, so I guess (2) can be applied to NIW 140 too. You'd
better ask a lawyer to confirm this. |

the end of your 6 year H-B period, then you can at least extend your H1B for
another year (or 3 years if I-140 gets approved). Please note, the time you
spent in China does not count into your 6 year H1B period.
