Federal prosecutors in Pittsburgh have charged 15 Chinese nationals in the U
.S. and China with fraud in a scheme to pay impostors to take college
entrance exams using fake passports for identification.
The U.S. attorney's office said the defendants, including two living in
Pittsburgh, defrauded Educational Testing Services and the College Board
between 2011 and 2015.
Prosecutors said some of the conspirators had counterfeit Chinese passports
made in China and sent to the U.S., where they were used by the impostors to
fool Educational Testing Services administrators into thinking they were
other people at tests conducted at various Pittsburgh-area locations.
The conspirators received the benefit of the impostor's test scores on the
SAT and other exams for use at American colleges, one of which is identified
in the indictment as Northeastern University in Boston.
The 35-count indictment, handed up May 21 and unsealed today, identifies
some of the defendants as students who paid up to $6,000 for others in the U
.S. to pretend to be them in taking tests, such as the SAT, at Barack Obama
Academy, a testing site in Monroeville and elsewhere.
Five of the defendants are identified in the indictment as test-takers,
including the lead defendant, Han Tong, 24, of Pittsburgh. Another local
defendant was identified as Gong Zhang, 23, of North Craig Street in Oakland
, who prosecutors said received a fake passport from an unidentified
conspirator in China on April 1, 2013, and then used it in posing as someone
else that day in taking the Test of English as a Foreign Language exam.
The beneficiaries of the scam then used the scores of the impostors to
obtain student visas so they could enter U.S. colleges.
Prosecutors would not say how many students were able to enter American
schools through the scheme but said the investigation is continuing.
U.S. Attorney David Hickton said Educational Testing Services and the
College Board have cooperated with investigators.
One of the 15 defendants, Siyuan Zhao, 24, of Massachusetts, who is
identified as one of the students who benefited from the scheme by sending a
bogus test score to Northeastern, was taken into custody in Boston today
and was scheduled for a hearing in federal court there this afternoon.
Prosecutors said they will ask that he be jailed and sent to Pittsburgh for
trial.
Mr. Tong and 10 others will be issued summons to appear in U.S. District
Court to face the charges. The names of three others, all in China, are
sealed.

A Northeastern University student from China is just a few courses short of
graduating—but he may never don the cap and gown because of a decision
federal prosecutors said he made four years ago.
According to the U.S. District Attorney’s Office, Siyuan Zhao was one of 15
Chinese nationals to pay people in the United States, mostly Western
Pennsylvania, to take college entry exams in their place.
In Zhao’s case, he’s accused of paying someone to take an English
proficiency test that he submitted with his Northeastern application, The
Boston Globe reports. Prosecutors said others paid as much as $6,000 for
stand-ins to take tests, including the SAT and GRE, according to the report.
Here’s how it worked, according to prosecutors:
The Chinese students had counterfeit passports made and sent them to the
test takers in the United States. The test takers would then use those
passports to pose as the students during the exams.
The overall 35-count indictment was unsealed Thursday, the same day Zhao, 23
, was taken into custody at his Revere home, according to The Globe.
Zhao was charged with using a false passport, conspiracy, wire fraud, and
mail fraud, according to the report. He had an initial court date Friday and
was ordered to remain under house arrest until his next court date in
Pennsylvania.
Zhao’s court-appointed attorney, Stellio Sinnis, did not immediately return
calls seeking comment Saturday.
A Northeastern spokeswoman declined to comment to The Globe regarding Zhao,
other than to say he’ll be referred to the office of student conduct.

目前,中国是美国最大的留学生源国。依照美国方面公开的数字,2013年至2014年
,入学美国高校的中国学生总计27.44万,占同年入学外国学生的31%。印度和韩国紧随
其后,占比分别达到11.6%和7.7%。
在美国,学生作弊情况同样严重。美国纽约检方2011年对20名学生提起诉讼,指控
他们2008年至2011年间参加SAT考试时雇人替考或充当“枪手”。20名学生中,15人雇
人替考,出价500美元至3600美元不等;5人充当“枪手”,伪造身份证件骗过考官。

When he was in high school in China, Siyuan Zhao wanted what hundreds of
thousands of his peers strive for every year: the prestige that comes with a
degree from a university in the United States.
And for Zhao, success seemed all but assured. He had good grades and was
admitted to a one-year precollege program at Northeastern University,
beginning his quest to study there full-time, according to his attorney.
Zhao was accepted, and four years later, his attorney says he is just a few
classes shy of graduation. But all that success was thrust into peril this
week when federal prosecutors charged him with paying someone to take an
English proficiency exam he submitted to Northeastern four years ago as part
of his application.
Zhao is one of 15 Chinese nationals charged in a federal indictment that
describes an international, but relatively simple, scheme that involved
students allegedly obtaining fake passports in China and sending them to
conspirators in Pennsylvania who took standardized tests for them.
The 23-year-old student, hands and feet shackled, stood in a federal
courtroom in Boston on Friday, hearing the charges.
In court, Zhao’s court-appointed attorney, Stellio Sinnis, described Zhao
as a good student who does not pose a risk of flight.
“He’s a very young, very frightened young man,” Sinnis told US Magistrate
Donald L. Cabell.
As part of the scheme, the conspirators in the United States would receive
the passports containing the personal information of the Chinese students,
and then an impostor’s photo would be pasted in, prosecutors said.
Some students allegedly paid impostors to take the SAT and GRE, paying as
much as $6,000 per test. Zhao allegedly paid someone to take the Test of
English as a Foreign Language. Zhao and the other students submitted those
scores to US colleges, authorities said.
An indictment charging Zhao and the 14 others, unsealed Thursday in US
District Court in Western Pennsylvania, includes 35 counts in total. Zhao
faces four charges — one count each of making and using a false passport,
conspiracy, wire fraud, and mail fraud.
Each count of wire fraud, mail fraud, and conspiracy could bring Zhao 20
years in prison, a fine of $250,000, or both. The conspiracy charge could
result in five years in prison, a fine of $250,000, or both, according to
the US attorney’s office in Pennsylvania.
Zhao is the only one of the 15 defendants who was arrested in Massachusetts,
and he was taken into custody Thursday at his home in Revere, attorneys
said.
The federal magistrate ordered Zhao to wear a GPS monitor and remain under
house arrest, and set a $25,000 bond until his next court date, which has
not been set but will be in Pennsylvania.
Two of Zhao’s college friends attended the court hearing Friday but
declined to comment.
During the hearing, federal prosecutor Amanda Strachan questioned federal
Homeland Security agent Robert Fisher, who participated in Zhao’s arrest.
Fisher said Zhao appears to possess ample financial resources, including a
bank account that once received a $50,000 deposit. He also owns, or has
owned, three luxury vehicles, including a Land Rover and two Mercedes-Benzes
, during his time in the United States, Fisher said.
The alleged cheating scheme took place at testing sites in Western
Pennsylvania between 2011 and 2015, the indictment says, but students sent
the scores to schools across the country.
Another student, Biyuan Li, is alleged to have wired $5,990 in 2014 from a
Massachusetts Bank of America account to an alleged coconspirator in China.
None of the other defendants is believed to be from Massachusetts.
Northeastern defended its admissions process Friday and declined to comment
on Zhao. The school receives about 50,000 applications each year and reviews
them for veracity. The school learned of the federal investigation in
August and was instructed to take no action, school spokeswoman Renata Nyul
said in a statement.
“The university will refer [Zhao] to our office of student conduct for
further action. We are prohibited by federal law from commenting further on
disciplinary matters regarding specific students,” she said.
The companies that administers the entrance exams, the Educational Testing
Service and the College Board, cooperated with the investigation,
prosecutors said.
College Board vice president Stacy Caldwell said in a statement Friday that
the organization attempts to identify and stop illegal activity that
undermines the integrity of the tests.
The indictment comes as the number of Chinese students admitted to colleges
in the United States hits all-time highs. There are five times as many
Chinese students on US campuses today as in 2000, according to data from the
Institute of International Education, a nonprofit that aims to boost higher
education globally.
As the number of Chinese students applying to US universities grows, schools
have become more vigilant about verifying pieces of applications found in
the past to be fraudulent, said Anna Katten, associate director of school
operations for the Burlington-based Ivy International Group, which helps
students from abroad who are entering US high schools.
Many of those students hope to continue on to college in the United States.

过去15年的出国考试历史,中国式作弊花样百出,而美国考试机构防不胜防,往往只能
对“时差作弊”这种充满想象力的手段瞠目结舌。
2000年左右,美国的考试机构对中国式作弊的理解还十分有限。2001年1月30日,
负责SAT、托福、托业、GRE等考试的美国教育考试服务中心(Educational Testing
Service, ETS)董事会几位负责人,联名发函到美国各大学,警告需对中国考生的托福
或GRE成绩持谨慎态度,称这些来自中国的学生“接受密集短期培训,占了大量便宜,
这些培训使用了尚未公开的试题”。
早年的ETS并不勤更换题库——部分旧题在培训于中被使用之后,仍然出现在了随
后几年ETS的考试题中,这些旧题大部分由各类语言培训机构提供。在ETS看来,中国学
生使用旧题就是作弊,就是对其他没有接受培训的学生的不公平。2002年5月30日,ETS
对新东方提起诉讼,指控新东方自1997年来非法使用和销售ETS拥有版权的完整考试题
,2004年12月27日,北京市高院做出终审判决,判ETS胜诉。
1999年,中国GRE考试开始启用机考。仅仅三年过后,2002年8月,由于中国、台湾
和韩国学生“史无前例”地在网上分享GRE考试的语文科题目,ETS决定在这些国家暂停
GRE机考,改为笔试。GRE又称美国研究生入学考试,是申请美国、加拿大各类研究生院
必须具备的一项成绩。ETS发难的直接原因是,部分考生不守信誉,不遵守考题保密协
定。
在此之前,考试机构ETS根本不会想到:参加过GRE的中国考生会自发分享“机经”
,未参加GRE的考生通常会在每个月月末“压轴”参加考试,因为GRE的题库会在下个月
月初迎来大更新,选择月末考试好处是,能够最大限度研究并记忆“机经”网站上由网
友提供的题目。到了2015年,这种“机经”(例如GMAT)一般由培训机构派人频繁参加考
试、“费心”将题目记下整理而成,培训机构会总结历史上换题库的日期,预测下一次
换题库日期。
“机智”的中国考生通过ETS的考试漏洞,又发明了“时差作弊”,这一作弊方法
被广泛运用于SAT、托福、GRE。2015年5月30日,美国一家华人网站报道,一名中国留
学生特地从美国德州飞往加州南部参加托福考试,因为全美同一天的托福考试使用同一
套题,且在同一时间开始考试,当处于中部时间(EST)的德州于上午10:00开考时,处于
太平洋时间(PST)只处于上午8:00,距离开考还有2个小时。德州的考生可以利用中途休
息,想办法将题目和答案传给位于加州的考生。
而且,身在中国大陆的考生,有的甚至不远千里前往泰国、越南、新加坡等东南亚
国家进行作弊。在2014年10月,ETS接到泰国曼谷的考官在SAT考试结束后发去的邮件,
邮件称“一名中国女生偷偷查看iPhone答案被我们抓了现行,这些答案都来自当天早些
时候澳大利亚举行的同一场考试”,澳大利亚时间要比泰国早三个小时。SAT又称为美
国大学入学考试。ETS对这一作弊手段瞠目结舌,为了防止时差作弊,ETS对题目做了修
改,例如现在SAT的写作部分就有四道作文题目,分别对应美国东部、美国西部、欧洲
考区、亚太。但即使是两个不同大区,重题率依然“较高”,远远无法阻止中国考生的
作弊行为。在托福考试中,这一时差漏洞已于2013年被堵上。
中国已是美国大学最大的外国生源“供应商”(占31%),但ETS从不公布中国学生的
作弊数量。可以知道的是,除了“时差作弊”,中国学生将本土考试的作弊方法原封不
动地也搬到了出国考试上,这些“常规手段”,仍然让美国人头疼不已。中国考生会聘
请各式各样的枪手,枪手使用合成伪造、与本人相似的一代身份证进行考试;美国最大
的中文媒体《世界日报》报道,2013年11月9日,一名参加托福考试的女生被当场逮到
在大腿内侧写有小抄,女生起初声称没有作弊,随后改口称“在中国都这样”(
everyone does this in China);网上流传的一封ETS信函,显示匿名考生因为从袖口
偷看别人发来的答案,被通知要取消成绩。
ETS试图遏制花样百出的作弊手段,他们在反作弊中用上了暗访、便衣检查和派出
人员假扮考生参加考试进行考试现场监控;他们收集考生个人信息和字迹样本,以供核
查;ETS还拍下考生照片,并在发送给成绩使用单位的打印成绩单中附上考生的数码相
片;在2012年底一代身份证在中国被全面废止后,对于大陆学生ETS就只认可二代身份
证。只不过道高一尺,魔高一丈,某些代考网站声称能按照考生相貌来寻找相似“枪手
”。
在与作弊考生“斗智斗勇”的过程中,ETS发现考前与考中的禁止还是存在许多“
漏网之鱼”,于是他们开始在考后“秋后算账”。ETS会对托福考试照进行横向对比,
多次替考者会被揪出;《南方周末》记者曾得到一封ETS发给某位“雇佣枪手”的中国
考生的信函,其中提到ETS对考生两次参加托福口语考试的声音进行了对比,判断出音
色不一致,取消其成绩。
2011年《纽约时报》报道,在堪萨斯州,几名通过托福考试的中国学生前去上课,
他们的真人长相却没法匹配托福考试时拍的“确认照”,成绩和入学资格被取消。而美
国留学中介机构“厚仁教育”展示的一个案例显示,一名中国学生在爱荷华大学就读,
学校突然收到ETS官方认定,称该学生在托福考试中作弊,取消考试成绩,爱荷华大学
可能将其开除。这类需求的旺盛导致该机构开辟了“学术紧急服务”,这项服务声称“
七天内成功转学保住身份”,专门促成大学给作弊学生第二次机会。
本次15名中国学生考试作弊“惊动”美国司法部,也实属正常。ETS是非营利机构
,它只能对学生的成绩进行“待定”、“取消”操作,如果对学生做出禁考处罚,期限
往往也只是3个月 – 1年不等。在2014年10月至2015年3月,ETS连续接到SAT考试作弊
举报,但也只是对中国、韩国等国家的部分考生成绩做了“延迟待定”处理。无论是否
作弊,这部分考生在未来1-2个月都无法报考美国大学。
另一方面,司法部向来家中打击考试作弊者。在2009年5月7日,美国司法部宣布在
国内13个州以及华盛顿特区逮捕了58名涉嫌在托福考试中作弊的外国留学生,被逮捕的
学生中大多数涉嫌花钱请“枪手”代考,还有一部分被逮捕者本身就是为他人考试的“
枪手”。
