我在一家 IT 公司 全职H1上班。 我原来实习的公司有一个项目让我做。 他们让我

independent contractor. 但是我现在不知道 什么合法，什么不合法。 还有都要有什
么手续。

发帖数: 41 | 5 Company registration doesn't address the requirement of
valid sattus, but a masquerading trial. The queston depends.
If he is a fresh H1, generally no chance. If he is obtaining
green card, he can do it (after filing 485, should be).
Other ways: (1)if the amount is not a big deal (<600), it may
be ok. (2). After having the check, cash it when you go back
to China. It may help.

任何时候都可以申请，只要名额还没用完。

without GC, you need sponsorship to work legally, i.e., you can't even work
for walmart on hourly paid basis.
independent contractor or so called 1099 base contractor, is a "business to
business" relationship between you and 原来实习的公司.
they just pay you (as a "business" or "company") a sum of money for each
invoice you give them, and you take care of your accounting and tax.
they'll ask you to fill a W-9 form (which requires your SSN or TIN as
a company) and report the money to IR

equity. |
