听说有人上面没有标示这个 就不用waiver 我感觉首先是你可以发邮件去确认下是否你
真的有212e？
如果有了再申请wavier。我听到过查询后没有212e的例子。仅供参考
我是公费的j1，waiver起来很麻烦，你的自费的肯定没问题，估计1-3月差不多完成，
如果顺利的话。 |

1）我是J-1（过期日期11/12/2016），是博后老千，我老婆J-2。
2）我的J1 waiver已经拿到手，并且NIW-140已经通过。
3）刚接了另一个大学的offer，双方约定给我转H1b在07/05/2016生效。
4）我老婆怀孕了，due date是07/24/2016。
5）本以为一切顺其自然就能转H1B，材料都已经发给学校律师。但是在整理材料的过程
中忽然记起老婆在2010到2011年间曾经是J1，因为她的J1 visa和DS2019表上都写着“
not subjected to 212e two year rules”，所以一直以为她不用搞豁免。直到前两天
看到版上好多人说就算visa和DS2019表上说not subject to 212e，只要是中国护照，
就要搞豁免，直接吓尿。
很多人说找DOS搞advisory opinion是最有效力的，所以今天打算把这个advisory
opinion先搞上。但是听说结果要1到2个月才能下来。如果新学校file了从J1J2转换成

rules”。

然后她美国境外面签H4，也很容易过了。
你哪里看到“就算visa和DS2019表上说not subject to 212e，只要是中国护照， 就要
搞豁免”？我不知道你妻子是什么J1。但应该没有用过中国或者美国经费。那样没理由

从事学习或者研究；要么是受美国以外的派出国政府等官方机构资助来美国从事学习或
者研究。
2. 美国政府规定，不论是受美国政府等相关机构经济资助还是受派出国政府等机构资
助的J-1签证持有者，学习结束后，要受到回国服务两年的规定。 也就是“the
regulations require that program sponsors apprise their exchange visitors of
the two-year home residency requirement.” 取得签证时，一般都会在护照签证上
被明确注签“SUBJECT TO SECTION 212E TWO YEAR RULE”，以便让签证获得者本人和
有权查验护照的人员，机构明确知道。
3. 虽然美国政府没有100%要求所有国家在所有专业领域持有J-1签证来美国学习或者研
究的学生在program结束后必须回国服务两年，但中国政府和美国签署的双边协议却规
定了，几乎全部的J-1签证的学生或者学者必须在期限结束后回国服务2年。

学校的IC好几次。后来刚来美国F1的第一个月就赶紧递交了豁免申请，免得夜长梦多

再入境一直到现在。最近想换成H签证了，有几个问题：
1，是不是要把前面的J2和现在的J1两个212e都waiver掉？还是我只需要把现在的
J1waiver掉就可以了？
2，如果两个都要waiver，那现在的问题是，我LP的J1可能暂时不能办理waiver（她的
所不大愿意issue H签证），那我可以提出J2单独办理waiver么？
3，还有就是，办理waiver一定要和单位协商么？还是完全可以跟单位没有关系的？
我们单位和我LP单位的管移民的大娘都说这种情况很少见，拿不准。大家帮忙啊！3X！ |

然后收到了I797C notice of action，可这I797C的notice type是receipt notice。
我又去查了一下DOS的状态： Department of State Decision: Favorable
Recommendation
（Recommendation Sent）
于是我现在就比较囧了，请问这样算是豁免完了，还是豁免进行中？后面还有好一阵子
？如果进行中，下面会发生什么事情？

期的两年后才能进入美国，还是说两年后才能通过sevis系统申请发ds2019表格？
问这个问题的原因是因为我距离上一次research scholar结束已经22个月了，那么24-
month-bar允许我的新的接收学校早于24个月派发ds2019吗？还是说甚至得等到第25个
月，international office才能派发ds2019？北京大使馆的面谈可以早于25个月发生吗？

国博士后.现在发现当时的DS-２０１９上面的"subject to the two-year residence
requirement based on" 以及" government financing"均被签证官打钩.签证上面也写
着"bearer is subject to section 212e".
我去瑞士留学之前有申请国家公派,被选上了,但是我没有要(因为瑞士的老板后来说可
以support我了).而且我也拿过优秀自费留学生奖学金,这应该说明我和中国政府没有经
济关系了啊.是不是这里的"government financing"是指瑞士政府?
我这种情况能申请豁免吗?有没有类似情况的朋友?

18，6/22分三次分别传真2024857696催促VO办理（这个电话是我查到
WaiverReviewDivision要求材料不全的applicant补交材料所用的传真号码。需要提供
自己的case number， 姓名、DOB、联系方式，邮箱或手机号码，简短几句话询问情况

反正F-1签证也下来了。就彻底忘了212e 2 year rule apply这件事情。
8年后的现在，我可以485转身份的时候，其实是已经牵了字，寄给律师之后，闲着无聊
