刚刚收到一封信，说如果在2009.2.18-12.1之间买入的可以receive a payment form
the proposed settlement of a securities clss action lawsuit pending in this
court. 很长的一封信，大致浏览了一下，总共要赔偿$3.6m，不知道我理解的对不对？
我刚查了一下，去年好想买了一点，而且是盈利的，这还能报么？ |

生雇佣政府职员用肤色作为参考因素只是60年代的权益之策，现在法理上越来越无法自
圆其说。
可是diversity和老黑孩子成绩差还是liberal最关心的问题，NYT就提倡一个观点要考

其实确实是这样，你实力没到那个地步，要求那个利益，绝对是祸不是福。老黑能搞出
AA，犹太人同样overrepresented却可以不受AA影响，都是因为背后有足够的势力，亚
裔不能团结起来搞个足够的势力的话，光取消AA是没用的，能搞你的地方太多了。 |

有兴趣的朋友可以Google "class action attorney". 然后把事情的经过详细客观的发
给多个律师。收到回音后在和律师近一部谈。
完全可以几个case一起上。比方说洛杉矶的华人一个class，纽约的华人一个class。华
人小孩和家长一个class，等等。

长，只是在前不久才被破格提拔我公安部常务副部长，在公安部的根基不稳，应该是受

那天就聽了，沒時間坐下來寫點聽後感。
要說聽後感其實就兩條，
一來是對待亞裔的態度的確跟60年代對待猶太人的態度是一樣的，
你們聰明能幹會掙錢，那麼要享受這個國家的各種福利，你就得忍著，
否則滾回老家去。
這個國家首先是白人的，然後是黑人的，現在開始包括南美裔，
什麽時候真的兼容並包亞裔，恐怕還未知。
也許要土共倒臺，中國社會納入所謂普世價值的意識形態，
大家平等對話，美國真正重視中國的地位而不僅僅是荷包的時候。
雖然中國人不代表亞裔全體，
但中國是亞洲地緣政治最重要的組成。
華裔在美國也幾乎是亞裔的標杆。
二來東亞裔和東南亞裔和印度裔，的確是不一樣的族群，

affirmative action违宪了。最高法院几十年前裁定AA作为一种race conscious
remedy是符合美国宪法的。
Race conscious remedy最早的出现是为了执行Brown v. Board of Education的
desegregate school并建立种族融合的学校的精神，所以AA的前身是affirmative
integration。 Brown案子大家应该都听说过，它实际上是两个部分，1954的第一部分
只判定了separate but equal 的教育系统违反了宪法中的equal protection，然后最
高法院在1955年裁决的第二部分里开始要求全国学区以最快的速度desegregate and
integrate。对于有些地区实行的affirmative integration，最高院在1971年的Swann
v. Charlotte Board of Education中判定这种方式是合法的，而且阐明学校have
