更新：看来大部分版友已经倾向于承认降级无法占条队。
希望大家跟自己的律师联系，询问他们所说的可以保留both 140的具体法律依据是什么
。同时也请他们解释USCIS exception里的amend覆盖掉老140的问题怎么解决。

最近发现很多降级的EB2C持有一个观念，就是降级到EB3以后，能够同时占两个队，保
留两份I-140。我仔细研究了一下各种资料，得到的结论是降级后原EB2的I-140将被覆
盖，降级的人将只能排EB3而失去EB2。具体如下：
1. 所有能够降级的理论基础就是AILA的一份备忘录，名称是“Multiple I-140s,
Priority Date Retention, and the 2013 China EB-2/EB-3 Anomaly”。而这份备忘
录非常明确地指出，在PERM 180天过期以后（也就是PD早于2013年初的同学），是无法

问了两个律师都是说只能做amendment，如果新的140批了，老的140肯定失效了。
但是看到论坛上有人说2.a 不勾选，也就是说是一个新的140。
原话是：
The Amend Box 2a.in the new I-140 for EB3 was Not checked. It is blank.

这个PDF上写的好像也说是要做amendment.
有点糊涂啊，请yoyo等有经验的人来澄清一下啊。毕竟如果老的140如果能保留，我们
还是希望保留啊。

这份文件是来自于American immigration lawyers association的；里面有这样一句话
：Premium processing is not available fro I-140 cases where the original
labor certification is not attached.
是不是要PP的话，得重新申请PERM，还是什么的？？？
还是，因为eb2与eb3各自独立，就不能有eb3 I-140 的PP？ |

away了。不信你用越来越短的sample来看，alpha肯定越来越小。
类似的还有January effect, weekend effect....
