高等教育认证委员会等处，获得最新的全球“野鸡大学”黑名单。此次更新的名单共曝
光未被认证的大学和教育机构691所，其中包括部分上回曝光过，但仍在运营的院校。
记者发现，学校数量虽下降了，但办学方式却有所翻新，而且办学地区也比两年前多了
10个，“野鸡大学”市场需求有增多趋势。
与旧名单相同的是，美国大学仍然占上榜院校总数的最大头，此次共有342所院校
和机构被曝光，约占总数的50%。其中又以夏威夷和加利福尼亚最多，分别有30所和45
所，共占全球总量的一成。
此次曝光院校所涉区域遍布全球46个国家和地区，比两年前多了10个，这说明一些
地区对野鸡大学的市场需求增多，导致野鸡大学在全球的“侵蚀”范围扩张。在院校种
类上，则比原来的综合大学、专业学院和远程教育三种少了一种，即远程教育学校。

回答：其实类似的案子历史上一共两次：1978年和2003年。当时的最高法院以5：4的微
弱优势准许在有限情况下用族裔作为录取条件。当时的swing vote Justice O'Connor
说：“25年后就不需要再有这样的‘族裔优先’了。”现在O'Connor已经退休。取代她
的Alito坚决反对任何族裔因素。据分析，现在的8位最高法官（第九位 Justice Kagan
已经因为conflict interest推出裁决）有四位(Alito, Roberts, Thomas, Scalia)是
会反对族裔优先的， 三位(Breyer, Ginsburg, Sotomayor)会支持。这样只有Justice
Kennedy是唯一的Swing vote.所以我们相信机会难得，我们这次真的可能一起来搭这个

这类法案，并非只有美国才有，中国在高考的时候，给少数民族加分，就是“平权
法案”的一种形式。之所以选这个题目，是因为我们华人特别地重视孩子的教育，这是
直接影响到接受教育的机会的话题。另外呢，去年，由于一个叫SCA5的法案，华人里的
新移民，开始积极介入美国的政治。而SCA5和“平权法案”是直接相关的。

很有想法的声音，给同学们很深刻的印象，多年之后记者采访，他的同学都能回忆起来。
至于他的学业成绩，他法学院毕业的时候，中等成绩。相比之下，Obama的成绩公布了
吗？
托马斯在法庭上常和他的朋友breyer传纸条。想不到吧，他的朋友不是保守派scalia。
最后，托马斯早有解释，他觉得，法庭争论毫无必要，所有观点都已经在法庭材料里。
这其实有道理，因为和高院打交道的人都是极其专业的律师了，高院的事情就是对法条

2003年，Grutter v. Bollinger一案，高院5：4判AA可以持续，但是在二十五年内应该
结束。五个支持AA的法官里，Ginsburg和Breyer同意这个判决结果，但是不认为AA应该
在二十五年里结束。
值得一提的是，另外那三个法官现在都已经离开人世，只剩这俩死硬分子还在位。

真的不及格。

2017年的春节注定无法平静度过，虽然美国没有假期，但是新上任的美国总统挑起的诸
多喧嚣远远盖过了中国的爆竹。穆斯林禁令引起国内外的一片哗然，当中夹杂着各种“
川普让美国核心竞争力丧失”的声音，似乎美国之所以强大靠的是穆斯林一样。笔者不
才，实在是想不出来暂停7个跟美国没有商业往来的国家的签证跟美国的核心竞争力有
什么关系，但却有心跟大家8一8美国的核心竞争力究竟是什么。
美国的核心竞争力是法制
美国立国200多年，能够一步步爬到世界唯一的强权，靠的是什么，猪肉认为不是飞机
大炮，不是美元和华尔街，不是硅谷和高科技，也不是民主自由。上面这些都是结果，
而造成这些结果的原因，是法制。
从建国之初，美国的建国先贤们就对自己创造的“政府”这个怪物有着异常的警惕，他
们从与英政府打交道的过程中深有体会，政府是可以随时调动包括军队在内的强力手段
，可以调动上千亿来自税收的财富和大批精英的巨兽，如果没有制度的保证，那个原本
期望是为人民效力的联邦政府，轻而易举地就可以做到金蝉脱壳，变成一个临驾于人民

纪和gorsuch差不多的，保守派非常兴奋，但是后来判决立场逐渐变得和金斯堡，
breyer差不多。
