If I have a stem OPT which will expire on may 2012, and I got an offer from
company A who will file H1-B on April 1st 2012 for me.
So, does stem OPT matter the H1-B Cap-gap extension in a way like whether A
is E-verified or not?? Or Stem extended OPT cannot extended anymore, sth
like that?

现在是学校的H1B，打算接受offer去公司，但是H1B得10月份开始。
公司visa律师（是个大公司）说，其实有些公司4月份递交申请以后，就允许开始工作
了。OPT->H1B这样是没有问题的，H1B->H1B，他说这是对law的liberal解释。他们公司之前没有先例，不过说可以从我开始。。。
risk是，如果H1B不批，需要立刻离开美国，并且在公司工作的那段时间属于illegal
status。
不知道有没有前辈有相关的经验，以及这样的liberal解释靠谱不靠谱？

过期，中间可能会出现几天的gap,由于申请的是cap exempt的签证，所以没有cap gap
extension, 这样这段时间就会变成grace period,请问这种情况在我拿到签证后可以直
接在美国change status么， 还是需要出国签回来啊 ？多谢！ |

但是学校发现SEVIS一直没有更新，所以没法打印新的I-20。最近刚提交data fix
request.
EB1A 485这周刚寄过去。不知道影不影响SEVIS和学校给我这个gap cap，以及我的H1B。
也不知道这个gap cap data fix 影不影响我的485.
如果大家有类似经验，可以分享下吗？非常感谢！！ |

程度上，吓退了一批烙印，看着几十年的排期，难免不打退堂鼓。倘若S386通过，我很
悲观的感觉，过了过渡期后，几乎所有的GC都是烙印的了。试想一下一个13亿的人口大
国，有着不错的英文教育，借着ICC的人口贩卖和H1b的滥用，谁不想来美国过好日子。
从此之后，就会看到乌泱乌泱的烙印占领美国。即使H1改革了，即使限制了ICC的人口
贩运了，还是有NIW EB1等途径可以保证烙印旱地拔葱般的从原产国来到美国。所以Cap
一旦取消，无法想象50年之后的美国是什么样子。 |

严重伤害其他族裔。美国保守派人士也不会坐视不管。
问题是一方面中国申请人逐年增加，另一方面绿卡供给量在2019财年突然腰斩，2020财
年因为吃不到EB4名额而更加恶化，按目前数据推算，2017年10月后的PD需要等3年以上
，往后每晚一年申请，要再多等至少2.5年。大量千老们怎么上岸？唯一的办法就是要
求提高CAP到25%。
为什么是25%这个数，因为中国和印度的人口大约各占世界人口四分之一，如果只给7%
的CAP，明显是对华裔和印度裔的歧视，是默认了他们只有28%的人口能达到世界人口的
平均智商。
至于增加EB类总名额，任重而道远，只能慢慢去争取了。目前争取提高CAP是唯一可行
的办法。 |

我在大学工作，但不是做研究，只是普通的程序员STAFF。现在学校说不给办绿卡，急
着找外面的工作，在找工作的时候recruiter问我H1B的类别，说academic是不能
transfer到industrial的，需要在每年的4月1日再申请新的H1B。
还有一个问题是，如果我的H1B是academic，那么重新申请industrial的H1B，时间再怎
么算？是重新算6年还是前面的时间都要算上？

系统里面）不是STEM专业。 律师收集了材料，想说明还是STEM专业,最后按照STEM要求
提交了延期申请。 2月USCIS 发来RFE，还是需要证明STEM专业。无法， 律师建议拖到
deadline（3个月）之后再重新递交原有材料. 同时在4月1日办H1B申请加急。
4月中H1B办下来了。 5月提交OPT延期RFE材料，很快被拒。 公司律师认为因为OPT延期
被拒在H1B批准之后，符合GAP-CAP情况，可以上班到10月1日H1B生效。
个人私下咨询其他律师，又说因为OPT延期申请在4/1之前，而且被拒，不能适用GAP-
CAP。
请各位大大指点一下，这种情况到底是否适用GAP-CAP。
如果不行，但是公司律师认为可以，我是不是可以装糊涂，继续上班，如果公司不举报
，USCIS不会知道？

楼主的OPT一月份结束，即使算上60天grace period，也cover不到4月1日。
虽然延期pending期间可以合法工作180天，但是这不代表OPT也被延长。
楼主提交H1B申请的时候是无F1无OPT但是可以合法工作的状态。
这种状态下申请H1B不能获得cap-gap。
并且，从OPT延期被拒之日起，楼主就不能再工作了。 |

去年用固定价不合算， 今年特意考虑CAPPED， 问题是CAPPED市场价都是他们公司自己

。 现在所有大宗商品都是通缩走势， 也许今后几年没必要锁定FIXED/CAPPED的了，
就像给车加油一样随行就市得了。

enforce that without media backslash.

秒的延迟，打出来的是大写。然后就都 是小写。我打字习惯用caps lock换大小写，对
我来说更快。上网查了一圈好像这个问题无解。有没哪个gui做的没这个bug？ |

June 1—If a player is cut after June 1, his remaining amortization (
acceleration) is spread out evenly over the next two years’ caps. If he’s
cut prior to June 1, then what’s in the year stays in the year and
everything else goes into the next year. Each team has two pre-June 1
exemptions in which those players may be cut before June 1 but treated on
the salary cap as though they were released after June 1.
