发帖数: 13407 | 2 以前在那上过两门课, 基本都是和2L一起上的, 压力很大. 平时上课时都没怎么听得很
明白, 最后就靠study guide, 好在分数还算能接受. 不过真的考完了, 却觉得两门课
还是挺有趣的, 没那么无聊.
L School一点好处是有的课平时没啥作业, 也没考试, 最后的考分就基于那个8小时的
考试.
我头一次那么长的考试算是献给了L School. 一本casebook, 一本statute就花了我$
200, 买的还是最便宜的. 卖又卖不大出去, 因为casebook, statute有时每年都会出新
的, 都会有变动, 哎! |

今天我早晨醒来，看着外面烟雨蒙蒙的波士顿，想起了去年的生日，
和roomie mm从外面wk回来，就看到了大家在版上给我的生日祝福。
一年后的今天，在这个寂静的象全世界人都彻底消失的夜晚，
等我从无聊的昏睡中再次醒来，无可奈何的捧起极其tedious的casebook,
居然又看到了大家的生日祝福，没想到大家居然还记得我，
真的是看的我鼻子一酸，眼泪差点儿都掉了下来...

但我可以纠正你一点，根据第一修正案，鼓动暴力的肯定犯法。我不仅学过第一修正案
专门关于言论自由的部分，而且读过很多这方面的书。你可以自己找本casebook看看。
另外，第一修正案的历史，原本就是曲折发展的。我之前写了很多了，你可以自己找着
看。

还有,就算鼓励暴力的言论违法（违法和犯刑事罪是两个概念）政府有限制此类自由的

个仔细分析
1. 政府限制此类言论可以采用什么样的方式,是不是可以直接把人抓起来
2. 怎么定义"鼓励暴力行为"需不需要有实际的暴力行为发生,影响力有多大,有没有暴
力造成的直接人身或者财产损失,因果
关系存在多少
另外,如果你觉得美国的民主体系,三权分立本身就不是普世价值,只是"合适"美国而已,
你费这么大劲儿照搬first
amendment这一套说明中国政府抓人有理,不是很大的逻辑错误吗... |

, 应该判的理由是他干扰了对方而不是踩线.
拦网的定义是在前排高于网的位置触球, 参见4.39. 跳不跳根本没有关系, 高个子即使
不跳手都超过网口. 矮个子(很多业余的)跳起来也不见得算拦网或是后排进攻, 关键看
的是高度.
老外定义这些规则力求精确无二义性, 依据的通常都是精确的数字, 比如高度, 尺寸, 次数等等, 不可能用什么"意图", "尝试"等等作为判断依据. 排球规则里面不是精确判罚的是持球, 没有定义在手上停留多少秒算持球. 判罚尺度由裁判自定. 可能很多人不知道, 实际比赛中裁判对二传的尺度最低, 只要别太过分, 通常都会让你接着干下去. 但其他队员的传球只要不太clean都会被吹. 据说理由是对二传判太紧整个队就没法打下去了. 所以看正式比赛其他队员不得不接应的时候多数用下手垫传, 就是怕被裁判抓. |

own procedural system.
Do you want to learn a particular state's, or the federal procedure?
At any rate, if you just want to learn some basics, then the federal sytem
should suffice. Glannon's Example & Explanation (E&E) is a well known
hornbook. You can find it at any law bookstore or online. Don't get a
casebook -- you'd feel hopelessly lost. |

it summarized the black letter law for you. However, I personally don't
think it is more helpful than reading the table of contents of the casebooks
in term of prep for the final exams. First of all, your prof is the master
of your universe, and he/she will decide what is the governing law in the
final and might expect your answers to reflect what cases/rules are
discussed in class. Reading study aids might confuse you i |
