我们2004年8月来美国，小孩是2008年底出生。
我们应该是分开填1040NR(EZ)，不能claim dependent。但是可以填
8901[Information on Qualifying Children Who Are Not Dependents(For Child Tax
Credit)]
1040NR上面是这么说的：
A qualifying child for purposes of the child tax credit is a child who:
Lived with you more than half of
2008. ...... A child is considered to
have lived with you for all of 2008 if the
child was born and died in 2008 and
your home was the child’s home for the

找出来仔细走了一下流程：你Schedule 8812 Part II 4a earned income确实是0，
Line 5、6都是0，然后如果没有三个以上小孩而且Line6是0，的确不能claim

但从你的主贴看，你应该能拿child credit而不是additional child credit吧。

系。
child credit，就是那个从1000涨到1600的，phase out bar提高了。

只能退回去年所交的700多块的税，没办法拿到1000足。
我的情况：f1, 小孩是2006年在美国生的。W2上的工资是11052，1042S上有近6000块（
包括5000 TAX TREATY的免税额和1000多免税的FELLOWSHIP). 原来不知道child tax
credit,填写的是1040NR-EZ,交了750的税。
重新填写1040NR，发现在第47项的child tax credit 只能填750。child tax credit还
剩余的250只能通过additional child tax credit 8812表来计算。可是8812上填写的
EARNED INCOME 似乎就是1040NR上的第八项，也就是W2上的工资11052，这个低于8812
表上的11750，所以算出来的additional child tax credit 是0。
这也就是说我只能把去年交的750税完全拿回来，不能通过additional child tax
credit 拿回 |

1. 你的AGI(line 38 at 1040)必须小于110,000 -- married filing jointly

举例:
a. 你的tax (line 44) = 300, 那么你的child tax credit 就是300
b. 你的tax (line 44) = 1200, 那么你的child tax credit 就是1000
c. 你的tax = 0, 那么你的child tax credit 就是0
而additional child tax credit defined at P61 就是说只要你有qualified

两个dependent, 我太太和儿子. 因为儿子是2007年12月15日出生,去年报税的时候,因
为第一次,所以不知道还有child tax and additional child tax credilt.后来是IRS
来信提醒才知道,可以报child tax credit,然后拿回来~500,但是填写的是8812 for
additional child tax credit.
今年 1040A, file-jointly, 填写了8812 for additonal child tax credit, 然后在
1040A上面还claim了868$ child tax credit, 因为但是看 file 8901 if required.
以为是需要就交, 不需要就不交. 今天联邦税回来了, 没有additional child tax
credit, 不知道是不是和没有交 8901有关? 另 |

发帖数: 12 | 40 我们的情况是：2014年5月拿到H1b，10月从国内过来美国，一个H1b加两个H4（配偶和
小孩）。2014年预扣的税是按w4单身算的，通过报税将预扣税全部退回，还额外拿了一
些Child Tax Credit。
7月15日去local IRS申请ITIN。
8月6日收到ITIN号。
8月31日收到邮件一周内refund到账户。
基于置顶的宝宝蛋同志的帖子，再做了一些总结和补充，希望以后的相同情况的人可以
少走一些弯路。

0.0. 4868 extension (Filed before April 15)
0.1. FBAR (Filed before June 30) －not related to tax refund, but need to

claim additional child tax credit. So if you only have 1 child, and your
tax liability is 0, your regular child tax credit will get wasted, you can't
claim it in additional child credit. Regular child tax credit is called non
-refundable credit, while additional CTC is refundable. |

Child tax credit是在三个条件同时成立的情况下可用:
• The child is a U.S. citizen, national, or resident alien, and
• The child is a son, daughter, adopted child, grandchild, stepchild,
or foster child, and
• The child was under age 17 at the end of the year.
这个可以参考4011这个很简明的手册.或者比较复杂但是详细的678FS. |

我老公是2007年2月来美国的。从2009年2月起，他应该算是resident了。但这是来美
的第三年，所以，他仍然享受中美treaty，没有交联邦税。他在2010年4月份报2009年
税时，填了1040表，将我儿报进去。我儿是2009年3月出生的。但因没交税，所以，与
数额有关的地方都填了0.
后来我们收到一份child tax credit。老公说，不用填，我们没交税，填了也没钱给。
过了几日，那份表可能就扔了。
今天我在irs官网上查到这样一句话，“ If you have no tax. Credits, such as
the child tax credit or the credit for child and dependent care expenses,
are used to reduce tax. If your tax on Form 1040, line 46, or Form 1040A,
