就像黑人百分比超过15%的13个州里，只有NY和MD是蓝州。
现在的加州，吃福利的比例够小，福利水平才可以这么高。
大赦之后，加州按照现在的福利水平，多出来的这些吃福利的人，就可以把加州财政吃
垮吃破产。
破产之后，大家才会发现福利是无底洞，才能回头搞conservative。
换句话说，福利是有钱的，吃福利人口比例小的州才能玩的奢侈。
所以越是黑人比例高的州，越穷的州，越是conservative. 比如Mississipi,
Louisiana, Georgia这黑人比例最高的三个州。而且这些州里出很多black
conservative, 比如condoleezza rice, Clarence Thomas, Tim Scott, Allen West,
Thomas Sowell. 我猜hispanic大赦之后也是一样的趋势吧。
当然同样的逻辑不能用在federal government 上，因为fed有印钞机，不会破产。 |

美国人(包括白人)在提起白人的种族歧视问题时，总是情不自禁地想到南方的“红脖子
”。
“红脖子”是一个历史性词汇，专门用来指南部那些低教育的穷困白人农 民。比如在
乔治亚和佛罗里达等地叫cracker，在阿巴拉契亚地区叫hillbilly。考察其词源，都有
强烈的贬义。有时人们干脆叫他们“白垃圾” (white trash)。不用说，这些名称既折
射出强烈的地域和阶级偏见，也反映了深刻的社会现实。
自殖民地时代起，南部和新英格兰地区的白人社会就有着强烈的不同。在新英格兰
特别是马萨诸塞，是典型的“五月花”清教徒地区。教科书上的故事虽然过分浪漫 化
、理想化，但在新英格兰落脚的白人，即使不是单纯的朝圣者，至少也属于文化教养比
较高的阶层，而且多是拖家带口的移民。这里很少有巨富，主要是自耕农社 会，大家
比较平等，清教徒那种勤俭奋斗的精神也大体是社会主流。相反，在南方的弗吉尼亚地
区，除了少数大农场主外，就是大量的卖身奴，即把自己的个人自由 出卖若干年，让

根據路透社，聯邦地方法院法官克萊布崔(Daniel Crabtree)本月4日判決宣布堪薩斯州
的同性婚禁令違反美國憲法「平等的法律保護」原則，堪薩斯州官員要求法院推翻這項
判決遭到駁回。
法新社報導，根據法庭文件，9位法官中只有史卡利亞(Antonia Scalia)與湯瑪斯(
Clarence Thomas)等位保守派法官反對。
另一方面，在南卡羅萊納州查爾斯頓(Charleston)，聯邦地方法院法官葛蓋爾(Richard

破格提拔。
而共和党是明显的白人党，为了粉饰门面，不得不给哪怕是完全不合格的少数族裔流出
"AA"名额。
最近的这个sue googe 就是个明显例子，一个做IT的，当过几年房地产经纪人，没有做
过local education board, 没当过county concil, 更没有干过州一级的立法机关，毫
无履历和经验，而仅仅因为外f和共和党地方上层搭上关系，加上一副反华的立场，就
成为共和党推出的少数民族的典型，居然在一向竞争激烈的共和党初选中过关(要知道共
和党多数党领袖就是在初选中落马的)，堂而皇之地成为共和党联邦议员候选人。
目前共和党唯一的黑人南卡参议员，如果不是被和党州长行政任命，很难想象他能在正
常初选中杀出来。
远的比如大法官Clarence Thomas, 就是因为原来的黑人大法官退休，老布什为了打黑
人牌硬推的年轻保守派，而左派的女权组织，人权组织，并没有因为他的黑人肤色而减
弱对他的反对。最后Thomas以本世纪最低票得到参院确认。 |

支持者基本上成为了 Single Issue voter, 只重复着对种族主义泛起的担忧。作为
Trump 的支持者，我想对同胞们说，在反对所有形式的种族主义，所有特别针对华人族
群的政策歧视，各种街头暴力和犯罪，咱们都是站在一起的，这点应该毫无疑问的。我
只是想说，不要把事情想的如同世界末日一般，因为那不是事实。比如，以往其他的
Single Issue focused 的极右“Pro-Life"们，和极左的 ”Gun Control"们都失去了
一定的 credibility：婴儿们并没有被毫无理由的肆意放弃，枪支也没有让大街小巷血
流成河。有一个例外，就是在几十年的民主党控制下，控枪最为严格的芝加哥，几白上
千非裔西裔青少年在对 Law and Order 的极端蔑视下，在帮派火并中失去生命。所以

两天的最高法院大法官任命听证，川普总统提名的大法官人选戈萨奇(Neil Gorsuch)面
对两党参议员对敏感社会议题、判例、政治倾向的各种提问，让人见识到金句连连。
面对议员询问如果川普要他推翻最高法院针对妇女能否堕胎的知名判例Roe v. Wade时
，听证会上不断强调自己「遵循判例(precedents)」的戈萨奇说，他会「走出门去」，
因为「那不是法官该做的。」
川普曾扬言要提名一位尊重生命的反堕胎大法官，但戈萨奇以法为尊，提到「没有人能
高於法律」，总统也是。如果戈萨奇切实尊重判例，川普恐怕会失望，但美国确定可以
留下一位守宪的大法官。
这场美国歷史上第113位大法官的任命听证，首日就有戏剧性开场，两位介绍主角的参

常小，而且现在不断爆出这个夏天有人会退休的消息，这个人八成是Kennedy，只要
Kennedy一退休，最高法院就会形成5:4的稳定保守派格局，到时候保守派里面最老的两
个，Alito和Clarence，也不过70左右，所以根本没有必要和猪党谈deal。至于
Ginsberg和Breyer，肯定是能撑一天算一天了 |

originalist，也算半个originalist吧，Roberts不是，如果老川接下来任命的都是
Gorsuch这样的originalist的话，感觉美国接下来几十年暂时还不会完蛋 |

Roberts << Alito < Gorsuch << Clarence
如果Kennedy退休，老川任命的应该是类似Gorsuch一样保守的，到时候Roberts就是保
守派里最不保守的了，倒并不一定说Roberts会变成Kennedy这样的这样swing vote
P.S. 我同意你的看法，Roberts当时投Obamacare赞成票的主要说法是不想legislating
from the bench，而是把立法权还给两院，从这个角度来说，确实是忠于宪法的保守
派风格 |
