compelling governmental interest是diversity。最高法院在Grutter(2003)里说了从
那时起过25年，这个compelling governmental interest就可能不存在了。现在已经过
了13年了。
现在Fisher的案子里一个论点就是要说明这个compelling interest已经不存在了。如
果没有了这个，那么racial based preferential treatment就是违宪了。这是正反双

至于同性和乱伦的关系，人家说的根本不是法律能不能修改成允许前者禁止后者。人家
说的是，反对限制同性婚姻的微薄理由同样适用于反对限制包括乱伦在内的许多异类“
婚姻”，这是法律范畴的问题，是个很严肃的问题，直接关系到这个问题应该用粗暴的
法律手段来解决，还是让社会自己去解决。
至今为止，未见哪怕一个自私的gay和其好心但********的支持者们说出为什么同性婚
姻不能限制，但乱伦能够限制。

50年代以前，常春藤联盟曾经对犹太学生设置了quota system， 比如当年费曼就是进
不了哈佛结果去了mit。后来犹太人对这事很抗议，有人说因为犹太人掌握了当时最大
的几家广播／报纸公司，所以可以发声。后来这个明显的quota system50年代以后基本
被放弃了。
但是，60年代的时候，犹太人是绝对站在民权运动一边的，直到今天，犹太人的投票都
是大部分站在liberals/democrates一边。 有很多原因可以解释这个现象，其一是因为
犹太人被歧视的历史（非wasp），其一是犹太人对正义公平这些理念（可以叫做意识形
态）很重视，其一也可能是犹太人对政治权力的理解很深。在美国作为人口少的族裔，
光投票是没用的，要推进自己的agenda，是需要跟其他族裔联盟的。政治上来讲，理念
，power of influence其实是很重要的。
diversity对非wasp来讲，肯定是有一定好处的。公开攻击diversity也会抹黑亚裔形象
