面签的时候还会被interview 吗？ 还是USCIS批准了就好，不会再被interview了？ 我

交140并不影响申请OPT。类似的情况请参见：很多人交了140之后一样申请OPT和OPT
extension
唯一和F签证的冲突就是，再也无法续签F签证。签证申请上会问，有没有交过移民申请
，填Yes，F肯定会拒签。
如果有五年F签证，倒是还好一些。入境的时候CBP一般不会想到问这个问题。看你有有
效签证和I20，一般就会放行了。
首先需要澄清的一个误解是, F1,J1身份完全可以申请绿卡, I-140和I-485都可以递交.
如果申请人的学术背景足够, I-140也会及时批准,没有耽搁. 只是I-485在批准前才需
要豁免批准证明 (waiver). 因此F1,-1签证持有者完全可以在F1,J1签证期间开始绿卡
申请.

to that question. For the reason part, I put "Visa application was rejected
because it was filed with Consular in Guangzhou when it should've been
filed with Consular in Beijing at that time." This was the case for my
parents but I'm not sure if it would apply to your mom.

要移民，先要公民petition，跟着等到petition批了而且排期到了才能真正申请绿卡（
Adjustment of status或consular processing）。petition本身对受益人身份没有影
响。
公民兄弟姐妹是F4类型，排期现在大概12.5年。就是说，petition递上了十几年之后才
能办Adjustment of status（如果那个时候在美国而且有合法身份）或consular
processing。
B签证逗留期最多6个月，所以要排期到的时候是合法身份的话，就要排期到之后或之前
6个月以内到美国。有petition排期那么快到的话，人家是不会让你用B签证进入美国的

我刚毕业，打算带家人去坐个Caribbean的游轮，就Carnival那种，visit US adjacent
islands。我有工作offer，大概5月入职，律师刚刚帮我file H1B petition。不知道
在这种情况下，坐cruise会不会有问题？
Concern是这样的(according to my 律师)。假设我H1B抽中了，如果我一直在境内，那
我的状态是change of status(也就是F1自动变成H1B)；但如果我在4月1日之后出境，
律师说我就不是change of status了，会变成consular notify，意味着我必须去使馆
签证来激活我的H1B status.

having applied for the visa. The actual act of
making an application for a visa is defined in
the consular officer's manual (I don't remember
exactly the section, but probably 9 FAM 41.101N).
Basically, you would need to have submitted both
the application fee (unless waived) and the
application forms and have them accepted by the
consular officer for adjudication, then it is
considered that the application is made.

I cited the federal regulation that allows you to
present a copy of the I-797A or I-797B to the
consular officer.
You really don't need to present the original
copy since the consular officer will check your
petition in the PIMS database, i.e., they trust
the case files in the PIMS database, not the paper
in your hand, whether it is the original or a copy.

发帖数: 76 | 47 版上最近不少去Montreal签证的， 我借鉴了很多经验， 大家都写得很详尽， 我就简
单写写自己的经历。
基本情况：PHD专业名字敏感（在TAL上面）， 去年10月刚毕业就OPT上班了， H1B今年
2月份批准的， 4月10号开始。 具体从事的工作不敏感（至少我觉得哈）， 跟
clinical trial相关。 7月份要去欧洲出差/开会， 9月份想回国， 不敢冒险去欧洲签
， 于是决定去Montreal。
提前一个月约好的， 之前刷了好几天都没有opening， 快要放弃了， 想实在不行就约
Ottawa吧。 结果有一天早上突然发现有N多的日期和时间，还来发了贴， 赶紧约上。
加拿大签证是公司指定的旅行社给办的， 该旅行社的DC分部给我讲每天下午DC的加拿
大大使馆接收agency代理的签证。 我就按照他们的要求填了某表， 提供了材料（全部
复印件）。 FEDEX overnite过去第二天下午签证就下来了。 果然没有照片。
6月12号开了5个半小时到了Montreal。 这个城市真的挺小挺旧的， 跟boston
downtown还有点点像。 停车路标都是法语， 查明白了才敢停。

"If you are planning to travel abroad while your U.S. non-immigrant visa
application is pending, let the Consular Officer know at the time of your
interview that you need to retain your passport. Once a decision is made on
your visa application, we will contact you and request you to return your

但是今天又看了一下，他们的主页上有写
