不大可能,新房的合同基本都是不平等条约,一般只有buyer需要卖掉旧房来finance新
房的contigency。不过有个办法,就是arbitration。。。

看中一个这里学区最好的房子。 greatschool上10-10-10(elem,junior,high)
离一条高速4个block。 2005年新建的。 离火车站1miles, 离wholefood half block
。 装修很不错。 2005-11卖了 1.085M。 现在卖主strategicly short sale。 还
没有miss payment。 现在出租一年。 旁边的房子, 50%比这还贵。
上市50天, 15天前从1M降到800K short sale。 银行还没批。 我们出价650K, 据
agent讲,他们受到另一个offer,远远比这高, 结果人家seller就拽了, 不理我们了
, 后来我们加到720K。 结果人家开始和我们讲价了。 还告诉我们他们期待的价格是
760K, 另一个offer是743K。 我们觉得不太对。 觉得人家肯定有contigency或者退出
了。 否则shortsale差 17K,谁管呀,还得银行批。 buyer agent全我们加到 744K。
我们觉得没必要, 甚至觉得720K可能都多了。
现在在反复考虑。

Use inspection contigency. Ask attorney to request seller to fix it. If
they refuse, you can back out without losing your earnest money.

My 2 cents
You should continue negotiating through your agent with the seller to close
the transaction.
If you want to sue the seller, I feel that you are most likely wasting your
time and money paid to the attorney. If you signed the contract claiming the
closing date to make the transaction and removed the contigency, you would
be fault if you can not close it on time. The seller has the right to take
away your deposit and refuse selling the property to you. The etscow company

On which base the seller can sue him? A deal is not closed and the contract
has no binding unless it is finalized. He can pull out the deal in many ways
if his buyer agent put in some contigencies into the contract. If the
property has a hoa he can pull out the contract with no reason after he got
the hoa code. He can pull out at the loan applicaiton stage. He won't even
need to worry about earnest money. But on the other hand appraisal can give

Attorney will choose tar title company they are familiar with, which may not
be the cheapest.
No appraisal contigency, if appraisal amount is lower and impact your loan
ratio below bank required ratio, you may have to paid the difference.

但是几天前卖主刚做的 wood pest inspection 没有任何问题。
找卖主要去年的tenting的report,卖主必须要给吗?不想拖到remove contigency之后
才知道tenting干了什么?
如果自己在找人查白蚁,需要注意那些地方?

可以,只要做过调研,SUBMIT任何OFFER都可以,但是如果太低的话,是浪费大家的时
间。
现金的OFFER在某些情况下优势很明显, 因为没有LOAN的CONTIGENCY,很多卖家会考虑
的。

谢谢。那些loan,inspection,appraisal 的contingency都在,可是还没到那一步,这
些contigency好像也用不上。合同里面也没有说这时退出会怎样。很纠结。。。

I placed an offer for a condo and is now in the middle of financing. But the
seller increased the HOA fee suddenly and I want to back out from the
contract now. I have a large amount of earnest money held by the seller and
want to get it back. The financial contigency period has already passed. I
wonder if there is any other way to back out from the contract and get my
earnest money back.

Do you have other contingency? I remember somebody said there should be hoa
contigence, but my contract did not have that either. We even agreed to lose
the deposit and now seller tried to sue us.

这个appraisal本来就是给银行看的,银行要买家出钱做,要不然不给你贷款,你有什
么办法。
还是有很多时候,appraisal低于买价的。尤其是目前的市场。所以加appraisal
contigency 也是一般offer都有的了。

inspection contigency已经签了, 听起来好像大家都觉得现在要太晚了, mortagage都
批了,不过rate还没lock. 第一次买房太没经验了,我们的agent也没提醒, 心里总觉得
不舒服,虽然可能也就能要个几百.

My agent sent off an offer letter, saying we will put down 10% when we sign
the contract. The contract will be signed after the inspection. I am
wondering if 10% as deposit is common, it as around 50K, which seems to be a
lot to me. The agent said that we can get the money back if we cannot get
the loan, we have loan contigency. The money is in escrow account. I just
think 50K is too much. If our loan cannot go through, can we get thie money
back for sure? Thank you.

可以撤,只要17天之内你没有remove掉contigency (inspection, financial, ...) .
但是,一般agent不愿意你这么做:快到手的鸭子飞了。
找一个好的agent重要,自己学习了解知识更重要。

圣诞节/新年银行放假,加上appraisal的时候seller联系不到耽误了几天,所以现在还
没有close。
条约上规定可以罚款吗?如果不给他罚款是否他只能决定把房子卖给别人?

Recently, a transaction didnot go through because of the HOA is not
incororated (Fannie Mae regulation). So contract get cancelled because of
financing contigency.
Contract specify Seller to pay for the HOA doc prepartion fee, however
escrow officer deduct the money from earnest money BUYER put in
and use the small print to ask buyer to cover the cost, is it resonale?

20号晚上,我们签了再次延期协议,但银行没有答应了(我们都怀疑他是不是有意说银
行没有答应)。
现在已经过了做inspection 的时间,他发过来termination form是23号,但我们拖着
一直没有签字,要求他改写为 我们对inspection 不满意。他不改。
如果我们不签字,他是不能把房子再放到市面上去卖。那是不是银行就默认我们会继续
买这个房子?
这样拖着,最后是不是还是对我们不利???

我以为这种 应该是能拿回来的
但是我看altisource的合同上面写着
这钱全看seller 愿不愿意退...
就是 一旦你签了合同 如果不能在mortgage contingency 前批下贷款 你earnest
money 就没了 extension你没有权利
