阿尼什·托马尔（Anish Toma）正在向印度政府申请工作。他很熟悉这个过程，因为这

物学教授罗伯特·伯恩斯坦发表了一封致方舟子的公开信，让这一事件再次升温。
在公开信中，伯恩斯坦教授指责方舟子的《科学是什么》引文抄袭了他的《论界定
科学理论》一文有关内容，并且要求方舟子就此事致歉。

自己新发明的api，你认为它没权去copyright。嗯，如果我们公司没权copyright我们
的api的话，copycat就会遍地开花，我们估计很快就倒闭了。起码我们这个领域再也不
需要很多的high pay的技术员，只要中国招几个大学生来实现一些底层的东西就好了，
谁还会花这么多时间，精力来开发新的产品？
还有很多人认为一个两个function call雷同就是violate别人的api，这个是从何而来
的？有些东西只有一种方法实现，这些东西就不可能被copyright，而且即使被
copyright了，在法庭上也站不住脚。 |

就是你以前公司如果对该技术申请了专利，那么你现在的公司就要获得授权才能用。
copyright只要你不是copy paste以前的代码，文档，资料等等就没问题，你可以重写
。同一个功能不能的实现没有丝毫问题。
Google跟Oracle打官司不是因为那9行代码，而是Java的API是不是受copyright保护，
还有就是就算是copyrightable，Google的Android是不是fair use。是fair use就不要
赔钱。有些老中主要是copy paste出问题，容易漏把柄。只要不copy paste，没有丝毫
问题。 |

somewhat nonsensical: if you have the copyright, you have the copyright;
the "delegated" seems redundant. So I guess what you're after is what
usually refered to as "non-exclusive copyright."

，允许，如果你发布的时候不声明，后来又opensource了，很多人加入了工作，你就不
能再声明copyrightable。
因为如果开始的时候挑明你是想象微软那样完全控制一个语言，别人就不跟你玩了。别
耽误大家的时间就好了。像linux,java，这么多人投入了这么多时间精力，api就不应
该再copyrightable了。

我时不时来生物版看看，因为我来北美也做了10年的科研，我自己觉得我有兴趣但

努力，虽然勉强过了USMLE，混进了住院，但我尽了最大努力做好，近50岁时从新开

届都进大firm的哪里的office了，我说了，上海北京香港的office不算。 而且即使算
上，现在这样的job offer也非常少。
IP里除了patent还有copyright和trademark那个言论是不是可以当笑话说了啊？版里谁
这点基本常识没有？您最近参加过OCI没有。大部分的IP firm如果你不符合条件考
patent bar是连resume都不收的。 您认识有几个中国人JD毕业的没有理工背景能去IP
firm做copyright和trademark？（我认识两个，做trademark的标榜自己是做corporate
的， 做copyright的说自己是做entertainment law.）我们当年说的IP热明显说的是
patent，绝对不是copyright和trademark，请您不要再继续误导。 我码了那么多字澄
