出租房的owner。Serve notice的时候才知道wife刚去世，notice就serve给了husband
。几天后受到probate notice是对wife的estate的，这个notice的publication日期是
六月。根据我州法律，小额法庭的案件需要先进性调解，调节日期是九月底。根据
probate notice，creditor有四个月的时间去court file claim，否则永久无法file。
那么我们庭外调解的日期刚刚在4个月的范围内。
因为我们的被告是LLC，我读了半天这个probate notice，没有理解和我们有什么关系
。因为wife只不过是公司的agent，那么我们告LLC，她的死和我们没有关系，那么这个
probate notice也没有关系，对吗？
前房东charge我们moving out很多钱，伪造receipt，而且拒绝商量，直接把账目卖到

美国的破产法是先保障creditor的权利，先是银行这种secured creditor，然后是供应
商以及象三鹿里面的受害人这种unsecured creditor，以及要是欠员工工资的话员工也
算unsecured creditor，然后是股东。至于员工一般是哪凉快哪待着去。
从这篇文章来看，好像国内的破产法是要先保证员工的利益，然后才是unsecured cred
itor。社会主义特色？
当然两种都能被骂，就看你什么立场。你要是站在员工立场，你就要骂美国式的不顾员
工死活。你要站在creditor立场，你就要骂中国式的。这个三鹿案子比较特殊的就是它
的unsecured creditors里面很多是产品受害人。这个确实不好办，无论先保障哪方都要
遭另外一方骂。 |

钱和report的，并不是直接买了creditor的债。所以他们说如果creditor同意去掉
report，他们就可以去除，所以我才打电话给creditor。
感觉我的case，creditor和collector并不是向你说的那样的关系。而且态度都是你还
是尽快付钱吧，但如果你有你的考虑我们也不逼你，根本不想negotiate。这也是我现
在无

信用情况。并在你的信用报告上留下记录，以后所有的creditor都能看见。这个行为会
减你的信用分。
soft就是不会被其他creditor看见的，只被你自己看见的行为。比如你自己查看你的信
用报告，或者别的信用卡公司为了给你发广告查看你的信用报告。这个行为不影响你的
信用分数。

么了。因为你的debt已经被creditor卖给了collection，creditor不能再control了。真
子来美国时间不太长吧？任何人的debt如果到了collection，是collection的义务来pr
ove这个debt是你的，而并不是反过来要你prove这个debt不是你的，明白？直接找信用
局dispute是正解。你到哪里问，这也都是最好的答案。

可以是同一个人：你， 不过Creditor追债的时候， 就不能躲避了。
如果你把信托制定成一个“别人的财产”， 那么Creditor就不能从别人那里追讨你的
债了。 比如：
Medicaid 也是你的Creditor, 一旦你生前动用了他们的"free"帮助， 等你上了天堂，
