个人认为 最有效的可能是 法律手段，如果以hate crime等罪名正式起诉ABC Jimmy
Kimmel， 让它丢掉饭碗，以后不能从事媒体工作， 经济上赔偿损失。
各个行业有规范，如教师，护士，警察，医生，政客都能因为违犯这些而终止Career，
媒体人不应是例外。
如果有几千人或上万人做原告， 那就不是淡淡道歉了之，赔钱就够它喝一壶的。
好像历史上还没有这么多原告去打同一个官司的，除了二战审判战败国。
在美国，想出名挣钱的律师还是很好找的。
一旦这样的官司打起来，影响力就出来了。如果能胜诉，这将是最强有力的回击。
有懂 civil right law, hate crime, child abuse 等等 的朋友说说吧。

保护非常深（宪法级别），非常宽（各种形式、媒体）。最简单的举例，美国纳粹党在
犹太人社区游行，地方出台法律愈加阻挠，纳粹党把地方政府告到联邦，判地方政府违
宪，纳粹党的行为算作一种政治语言而受到保护.
那么怎么办？如果HATE SPEECH在雇佣关系中造成了敌意气氛的工作环境，则雇员就可
以状诉雇主放任HATE SPEECH，而且一般这种对于雇员很有利。 PAULA DEEN的雇员输掉
官司，关键在于比原告是个白人。估计是黑人社团在PAULA DEEN解雇过的雇员里找出来
的，而实在找不到黑人雇员.

Paula Deen（就是名校同学所引的 China Daily 报纸上的那个案子）被告的原因不是
因为她说了什么种族歧视的言语，原告所告的是性骚扰，以及黑人员工因为种族原因而
受到不平等的待遇。原告书状在底下，自己去看：

许多大公司的员工会去告公司，说因为性别、年龄、种族等而受到不平等待遇，Paula
Deen 的案子就是这种案子。只不过原告是白人，她 “帮” 黑人去告 Paula Deen 说
黑人因为种族问题而未获得重视。原告所告的罪名是因为种族而引起的工作平权问题，
只不过在原告的书状里提到了一些公司里存在的种族歧视言论；她告的罪名不是发表歧
视性言论。
这样清楚了没？
（后来本案因为原告是白人而被撤销。只不过在审理期间，Paula Deen 在采证的时候
承认她说过 N-word 而引起轩然大波，那时距离她被告已经一年多了。如果不是这样，

1.Palla Deen 只是说以前历史上用过那个词侮辱过黑人，而ABC是当今宣扬种族歧视和
种族清洗。
2.Deen赢得原因关键是 原告是一个白人：

的观点投赞助，这是搪塞，那为什么他们把paula deen的赞助撤了，还有walmart？因
为黑人是他们客户群。而且paula deen是吃了官司才被撤节目的。如果我们真刀真枪地
投诉或者告鸡毛，应该会有作用吧。打嘴仗，操纵舆论是媒体的强项，但是打官司就不
一定。fcc那个我已经提交了，不知道那个有什么用，先交了再说。

参考PAULA DEEN，官司也是团队内部员工起诉，起诉理由也是workplace hostile
environment（放任种族歧视导致有敌意工作环境氛围）。这种官司对雇员倾斜，因为

几觉得非要fire Jimmy 不可了. Paula Deen 因为几十年前说的几个词而下台, 而且
还是私下说的,证实之后就被fire了. 唯有如此, 这个社会才不敢公开歧视黑人. Jimmy
Kimmel 当众鼓励小孩的这种话语, 作为一个媒体人, 是非常严重的失误,必须fire 掉
, 否则以后辱华言论更为层出不穷. 今天不把Jimmy fire 掉, "杀中国人就不用还债"
成为一个有趣的观点, 中国人就等为美国人买单吧.等美国人发现真的偿还不了债务的
时候, 今天的玩笑就是明天的方法.到时候想阻止都阻止不住,因为这种想法已经深入人

根本上认识到了在美国自己的权利和利益只有靠自己去争取和维护。只有我们自己知道
捍卫自己的利益，才能赢得别人的尊重。
个人觉得签名和请愿只是表达个人意愿的手段。在法治社会，纠纷还是要靠法律解决。
我觉得下一步华人社团应该组织起来集团sue JK for promoting racial hatred,
child hood violence etc. 首先我们可以找专门打civil justice /civil liberty 的
律师。律师从赚钱的角度会Figure out how to sue.
前几天有网友比较了 Paula Deen 和 Jimmy Kemmel. Deen 最后在电台痛哭流泣注意
是因为 big sponsors withdrew the sponsor and pull her book off shelf. 这些
人不让他们出血是不知道疼的。在美国经济做杠杆比政治做杠杆有效。白宫可以对我们
的请愿推诿，华裔议员可以装聋作哑，法律手段是制服这些人的最有效手段。

She apologized! That's the only "mistake" she made in handling the case.
Was she forgiven for that? No. Mob does not care. If just sees everyone in
court; then it becomes a defendable case. There is absolutely no legal case
here can be made against JM...well. you can say I lack imagination how it
could possibly be won.
So one could apologize and be treated like Paul's Deen or fight in the court
