我建议如果位置差不多的话去,大公司。
如果小公司责任多很多,那可以考虑小公司(比如可以多管一层人,或者当一个部门的
头,然后这个部门以后可能有很大的发展)。如果这样的话要狠狠地要股权,base倒是
其次,反正以后干好了很容易涨。
最后,如果要去小公司,要问问自己是不是真的有这样的冲劲,能够在一群聪明又拼命
的人里面脱颖而出。还有家庭是不是能够支持你。小公司的特点是promotion跟
demotion都很快,适合聪明,愿意拼命的单身人士。

在星期一的会议 (Aug 7),果然是PIP,列的一些理由好多非常荒谬。
1. 说我code review的时候没发现别人的严重bug。其实所有的人都approve了,老板的
小红我也没发现也approve了,单挑我的问题。
2. 说我code的命名不好,但举不出任何例子
3. 有次会议迟到一个小时 这个也要说(是没通知),但是是生病了起晚了没办法通知
啊。
4. 还有好多莫须有的东西
有些是实际上的问题。后来跟老板单独谈的结果是:他其实觉得我工作还行,但是达不
到Senior的要求。所以想fire我。其实找的理由好多都是欲加之罪而已。
当时会议我蛮激动的,与会的有Manger, Director of engineer, HR,我。几乎全程是
Director 在主导这个过程(他是新来几周而已),感觉我的Manager跟我共事太久下不
了这个手。
Director提出的所有的PIP的理由我都当场反驳了。反正流程走完了,我立刻说要请三
周假,再回来讨论PIP。HR说我performance有问题不能再请假。

这是公司给你下的套,建议你不要签。这公司真是坏到骨子里了,也SB到骨子里了。
从Software Engineer变成Software Programmer应该算是demotion,这又是实打实的报
复,而且对你构成实质伤害,并且留下实质证据了。你可以咨询/报告给EEOC。
Software Programmer是另一个title会导致你H1B不能用(在申请H1B的时候是不一样的
)。
无论如何楼主MM赶紧开始面试新公司,做好后备手段,版上的人都能给你refer各家公
司的。加油!

公司世界500强,我们是科研部门,花钱太多,后来经济不好公司去年把组解散了。大部
分人都分到各个部门,少部分被雷,也有主动走的。这里海龟的不全是2009年以后。也
包括一些其他相近部门的人。
A. 本部门老大,本公司Chief XXX。海龟上海任亚太director,管将近100人,手下若干
director。外派,每月租房补贴5千美元,孩子上国际学校,专派司机。现在兼管美国的
一个规模类似的组。每天空中飞人。
B. 另一个部门老大,海龟香港,任同行业另一个重要配件公司VP,年收入据说近百万美

挤破脑袋,进了个喜欢的公司。当时,也没有考虑工作和不合适。进去后,发现入错了
行。不过现在快半年了,熟了,也就忍下来了。突然要给我个我喜欢的工作。那个工作
是我以前做的工作,而且前景也不错,会认识很多人,面广。如果当初面试,我肯定不
犹豫就答应了。可是现在呆了一怔了,知道那个新工作会很累,因为老板very tough,
是个年轻人,一心往上爬,所以会逼得很紧,然后还得管一个已经被那个tough
manager 搞得满心怨气的人,而且那个人还会觉得我中途插进去,对他是demotion,
怨气更大....心生怯意,决定不去了。。。。都说老板比工作重要,现在好不容易在新
的组混得熟点,真怕从新来一趟。。。。孩子还小,觉得折腾不动。。。我选择的对吗

50岁还没做到Director above的,等着被开吧。公司不会养着你到退休给你发高价
Pension的
做到Director的,没抱牢大腿也是开你没商量。最好也就是换个下家,但再往上走就难
了。不demote已经不错了。好多人70年代末80年代初大学毕业的那茬,LinkedIn上简历
,已经做了十几年的director,东家做到西家,头衔永远不变
只有做到VP或CXO这种Executive的才稍微好一点,即使被裁,拿的遣散费也足以养老,
换个下家也还是Executive或者Board

been promoted and got a raise and a bonus, including a retention bonus tied
to my new class. I still work in the same function as before. Now my HR
forced my boss to withdraw the promotion because my immigration status--said
that due to the promotion, my job description will change, which will
result in my ineligibility for the current H-1. my 140 has been approved and
am still waiting to file 485 due to the quota.

基本情况:PERM+140都已批。PD是2011五月。
最近都有升职机会。前几个月看到VB一直高歌猛进,就跟单位说想暂时观望下,没准熬
到年底能交485,就不想再折腾新的PERM了。可是目前的形势又变得没那么乐观,就考
虑还是先升职好了。
问题是,按照新职位再弄的PERM和140是否会取消目前已经批准的PERM, 140?换句话说
,万一新PERM或者140出了问题,还能不能demote到原来的位置,继续使用老的140?

managerial的role,单位律师和你的建议一样, 说到时候多加个amendment 或者
demotion半年。

yes you can, technically, you can just be promoted to the prev wage level 3
months before you obtain the GC, and then 3 months after obtain the card,
demotion.
3 months is a safe number. you can literally do it 1 week before and after.

自己也混淆很久,律师解释加上自己考古之后有了一点心得,总结一下,有不对的地方
大家可以讨论。一般来说会有三个job title, H1b job title, current job title,
Perm/140 job title。
理论上来说H1b title和current title需要保持一致,也就是说如果你title有变化,
需要通知相关部门修改h1b title。
如果你的h1b title和current title不一样,但是又没有改h1b title怎么办?那就忘
了你的current title吧,用h1b title。因为你在美国的合法身份是h1b,title也需要
是上面那个。
perm/140 job title是你未来的工作title,也就是你拿到绿卡之后公司要offer给你的
title,不是current的,所以可以和h1b或current title不一样,而且不要低于你的
h1b/current title。如果低于了就很让人怀疑,比如说你current title是senior

Let me be clear, it is OK if your employer says you are a manager when you
file 485, but you need to ask your attorney.
The problem is the job description rather than "demotion". You have done
your market test in PERM to prove that your job description cannot be
performed by an American citizen, now the whole green card is based on that
assumption.
You should ask your attorney.
