持有H1b工作3年，公司8月提交extention材料，PP, 但是换了一个level更高职位，web
developer。I94 9月17日已过期。
收到RFE后，质疑不需要本科学历和special skills。补材料后，因为IT部门高层人事
变动，需要的一些材料始终没有收齐，感恩节前11月19日寄出。12月3日收到deny,公司
12月11日下班前通知我，无法继续聘用。公司不愿再sponsor新的职位，因为opening比
我目前职位level更低。
请问目前还有什么选择?
1. 如果请公司公司appeal，这段时间我不能工作，但是否能合法留下？
2. 尽快找到能sponsor H1的工作，时间是是否可行？
3. 找一个学校拿i20, 转F1, 1月中下旬春季入学，是否来得及？
公司律师建议是需要处理好自己事务，尽快离境……

"The notice of filing submitted by the employer contains a wage of $$$$$$,
which is lower than the offered wage of $$$$$ listed in item G.1 on the ETA
Form 9089. Because the employer offered a lower wage on the Notice of
Filing less favorable than that offered to the foreign worker |

into the US or been deported from the US?
我妈在2007年秋天两次在北京申请B-2 visa被据。但后来在2010夏天申请签证成功，并
过来两次看我。
我不太清楚是否应该回答Yes，不知道如果写Yes,会有什么不好的后果。

无PRESENTATION, 将其当成INVITATION TALK来处理; 有无来往信件或EMAIL请教或讨论

民局的责任吧。
Intent to deny is a judgment without prejudice, thus it has no bearing on
the merit of your case. So don't worry about it. Ask your attorney to show
you the evidence that the immigration office received your supporting
documents and signed your package. And submit the evidence again.

deal with it. Just send the whole package again.
As I have said earlier, intent to deny is a judgment without prejudice, thus

I should not claim reward. The letter shows that USCIS found the visa

We just received the approval notice of our I485 applications. The H4
application is still pending.
Should I call USCIS to withdraw the H4 application, or wait it to be denied?

很郁闷也很气愤
等了14天， 晚上收到了 uscis faxed denial notice.发现完全是照抄上次的rfe
letter, 我们花了好多心思准备的rfe response 里的evidence 压根提都没有提。真不
知道是他们没看？还是他们没收到完整的材料？ 还是他们看了懒得再写反驳，直接用
上次的信就把我据了。不知道板上被拒的有没有碰到同样情况的。
肯定不会去appeal了。 还有一个选择是Motion to reopen , 不知道板上有没有人又经
验。 reopen 后还是同一个officer 审查么？如果真是这次漏看我的材料， 我倒不怕
让他重新看。
或者我在file 一个新的 case？板上有人被拒后马上重新file 的么？

My case was denied after RFE. Our university (tier 1) wants to appeal
because they need to keep university integrity. But my immigration lawyer
suggested that appeal would take pretty long time because it will be
submitted to D.C. Several of my friends waited a few months and re-
submitted, they all got approved without major changes. Good luck. |

Denial was issued by a different IO, TSC XM1219，
who didn't care about my response to the RFE at all，
but denied for the reason of lack of evidence/establishment that were
actually presented in the original petition and was already accepted by the
initial IO.
所以给正准备RFE的童鞋提个醒，
response to RFE的时候最好把initial petition的东西（即便是已经认可的）也都附
上并陈述一遍。
以免碰到不同的IO review，
只看你的RFE response不看initial petition，
然后就说你没这没那，就给拒了。
现在悲剧了，

that, and has not come back as of today (June 20, 2011)...
We will probably never know the reason why 277 handled my RFE response, or did not handle your RFE response. Only thing we know is that the luck is not on
our side :-(
