你确实一错再错。你固执的认为“从法律角度讲,一个人有三种状态:无罪、有罪、待
决定”。但是在美国法律的基石-presumption of innocence - 上,只有两种状态,无
罪和有罪。没有你所说的第三种状态。在定罪前是无罪的,而定罪靠的是控方的证据。
建议你看看wikipedia的关于presumption of innocence的条目。开宗明义:
The presumption of innocence is the principle that one is considered
innocent unless proven guilty. It was traditionally expressed by the Latin
maxim ei incumbit probatio qui dicit, non qui negat (“the burden of proof
is on the one who declares, not on one who denies”).

之所以會有此樓,是因為有些人說因為“無罪推定”(again, 我認為這是
錯誤的翻譯
),所以就應該認定他無罪,而且在沒有其他旁證下,就應該不要開聽證會。這說法你
覺得如何?
