鉴于生物的博士后周期都比较长，一不小心三五年就过去了，所以建议刚来美国做博士
后就可以开始交绿卡申请了。先排着队吧。尤其是做博士后的同学们已经有paper了。
J1期间可以开始申请140，但485批准之前一定需要J1 waiver。J1期间申请绿卡的最大

住的时间还没有在美国长，你如果是移民官会认为这个申请人没有移民倾向吗？延期本
身不是主要问题，而是延期后在中国住太短了。如果你觉得不差钱，老人也接受，多去
试几次也无妨，遇上心情好的签证官也许就给了，毕竟这是discretional的，要不就多
住一两年再说。另外，老人是不是不知道签证是discretional不是statutory？可以理
解为什么会伤心但是确实就事论事这件事她没有错领馆也没有。 |

PD），2009年底批准。2009年4月申请EB1a,2010年1月RFE后被拒。 2012年1月排期到了
和lg一起基于NIW被批准的140递交I485，后来陆续收到EAD和AP。我本人没有申请EAD，
还用H1b。都是DIY。
今天收到cis的正式拒信了。原因让人气愤。说是根据USCIS的纪录，我的I140表在2010
年1月被拒了，所以我不具备递交485的资格。我把信录了一遍在下面，请大家给看看是
不是这个意思。
他们一个不负责任的错误，我们就又得打仗似地应对，人力物力财力。觉得挺委屈的，
运气怎么这么差。身体、工作、孩子的原因，本来就疲惫不堪了，结果这样少见的事情
还让我们遇见了。而且因为我DIY，现在都不知道该怎么办，是自己弄还是请律师，是
reopen还是reconsider还是appeal，有什么区别？肯请大家帮帮我给出出主意吧。先谢

外全C显然违法，而放水（以减少浪费的理由）则可以说是within their discretion。
就像非法移民的递解全部defer显然违法，但是defer子女为公民或永久居民的非法移民
则可以argue为within discretion。 |

你理解的有问题，如果是salary 但是职责不符合要求，例如一个年薪8万刷马桶的。。
。那么这哥们只要工作超过40小时，超时工资就要按 80,000/52/40= 38.46 (基础工资
）*1.5 = $57.69 支付。
在这里，salary 与否和他exempt是无关的。
反过来，如果一个快餐店manager 收入只有$420/周，但他的职责完全符合要求，他也
不是exempt的。 如果他工作超过40小时每周，也要被支付超时工资。

假设一个没有跑攻的球队，反复传球在ENDZONE被PI，反正最后都是ball on 1 yard
line。
对方break free马上要跑TD，替补队员或者教练员上去tackle了。 反正你怎么罚
unsportslike conduct，都顶不上一个TD把。
还有棒球没出界的球，被球童当成出界接了。 这个每个赛季都有一两次。

俺觉得的确应该有个clock读秒， 但应该是裁判可以掌握的clock, 比方说， 刚打完一
个几十下的rally, 不但发球的人，接发的也需要踹口气，更不用说观众和电视解说都
需要时间回味和赞叹。 所以这时候裁判该有个discretion. 但要这样，什么时候该有
什么时候不该有discretion,又成话题了。
另外，如果读秒，时间到了怎么办，弄个什么哨声，亮个什么灯么？ 要是刚好抛起发
球时间到了，如何灭掉哨声或灯以免打扰？ 还是这正好是个对你拖沓的惩罚？
所以有很多细节需要研究。 感觉网球界都太保守，什么改变都挺难，所以也就是说说

看看是不是更容易明白。假设楼主在 485 pending 时有 H1B 身份，
同时假设楼主 lose job 有一段时间了，因此不能 port H1B 到
新的 employer（有关 porting 的法律是新的，我不太清楚新
形势，可能会有误）。
1. before 485 pending -> H1B
2. after 485 pending, before lose job -> AoS + underlying H1B
3. after lose job -> AoS (underlying H1B invalidated due to lose job)
4. use EAD work for a new job -> AoS
之如果楼主还想要 H1B，首先这么做：
（1）看看有没有 H1B quota，或者排队情况。
（2）查查 USCIS 的 memo，至少要保证 USCIS 没有公开说 AoS
的情况下肯定不批 H1B，否则浪费感情。
如果以上两条都可行，楼主按法律是可以申请一个新的 H1B，但是
