昨天开高速，本来在中间的lane，大概65-75之间。我前面就是一辆警车，再前面一辆
车比较慢，大概低于65（可能因为警车在后的原因）。然后警车换到最左lane,超过去
了。我也换到最左lane，跟在警车后面，大概也就70-75左右，可能偏70，记不清了。
当时想着，我在警车后面，怎么样也不可能说我超速吧。然后想不到的事发生了，开了
一小会之后，那辆警车居然把速度放得很慢，绕到我后面然，拦下我说我超速，他说我
开了80。
然后就是和他辩解，反正最后给了我ticket.
大家觉得这种speeding ticket有可能dismiss吗？他应该没有任何实质证据啊？他说我
80是因为他自己80，然后号称我和他距离保持一致，所以我也是80。大家怎么看？ |

方信息不准确。而且最好能找到证据。

，请问大家，如果我上庭是，警察没来，这种我全责的情况，法官也会dismiss吗？
如果警察没来，法官也不dismiss，我能要求社区服务来免掉罚单吗？ 听说还有一种是
去上驾校免罚单，可是驾校是不是反而更贵呢？车已经报保险了，半年后肯定保险会涨
，这时候免掉罚单对降低保费还有帮助吗？

然后就一个刹车减速，当时是过线半个车身，脑子里面竟然想到的是无法后退，所以就
直接踩油门继续左转。然后旁边的警车就亮了。。。
citation code是CVC 21453(a)-red light.
这个citation有法子dismiss吗？ 还有值得请律师dismiss吗？

没有记录的话，那么下次在购买保险的时候（做quote），当被问到是否有violation，
包括speeding ticket的时候，是否需要告知曾经拿到过ticket呢？毕竟拿到是事实，

as
the motion to dismiss is granted or the case is dismissed with prejudice.
另外你老公有没有受到惩罚. 惩罚是否完成等等也许有必要.

今年2月4号HOUSTON冰冻那天,我家LD翻车, 车total了.可气的是警察居然给开了张票,
说说是没有控制住速度.(那天八百多起事故呢). LD要认罚,要让律师来做(很多律师来
信要接活,大约70~80$),我没让. 七月份去出庭,从早上等到中午,都没有叫她.后来去问
怎么回事,人家一看,说早上刚开庭的时候,念了一大堆人的名字,让这些人连dismiss的
单子都不给,直接就可以走了. 那名单里就有她! 可惜没注意听,白等了足足半天... |

再谈谈过程吧，前两个帖子已经有很多内容，在这里说说接下来我向court提供的材料。
我主要提供了4份材料
1.要求延期，提供证明；我正好要出远门。有很多讲如何beat speeding tickets，有
兴趣的可以搜一下，其中第一条就是拖延上庭时间。我也打电话向judge确认了一下延
期的新时间。
2.要求警察提供雷达的型号、注册信息、校正时间、资格证等一些列材料，这些也是在
英文网站上找到的。
3.出示了Texas Traffic Laws里面关于限速的季节，指出我行驶的路段(US/TX hwy,
outside urban)被指名是可以开70mph的

在问几个问题,
1, dismiss letter后说是可以申诉(appeal)是不是申诉也基本上没机会?老美心硬啊,
照章办事.,不懂,还是这个是一个步骤,还是可以挽回一下?
2,申请community college真是个办法,可能只有这个最快了,但是申请后拿到offer再有
F1签证一共要多长时间?我现在一点概念也没有.
3,我还是想在申请商学院,赶在9-10-11申请季节,不知道你说的申请表是不是指商学院
的申请?商学院的申请package很大,无所不包的样子,最关键的是被dismiss的,还能转学
分吗?还是干脆重新开始?

第一张罚单。当时的情况是 No U-turn 标记被树叶挡住了，很难看清。于是我决定先
不交罚款，准备上庭去争取免掉。
上周上庭的时候运气不错，给我开罚单的警察没有到庭，所以我的 case 被法官
dismiss 掉了。我想问一下，这种情况是不是在我的 driving record 上就没有记录啦

所以我觉得可能是除了这5页材料以外，我还举了一些法律条款和要他们举证吧。没准
他们就觉得烦了什么的，不可复制，照搬的败诉了我可不负责任。侥幸吧。还是开车规

当时在一个限55的路上开，到了一个小村子，限速到了30，当时路上没人也没车，就没
立即减速
到了一个路口就开始减速，过路口后，看到警车从那个路口另外方向转过来，赶快看了
下速度表，正好30，而且那个警车也没打灯，就在后面跟着，当时以为没事了。
他跟了小一个Mile后打了灯把我给pull over了，说是我过那个路口前开54，给了张
ticket，我当时在36上，他ticket上写的在39上（36旁边的一个highway）
他说我住加州比较远，让我直接Mail回去Plea guilty就行了，要是不想plea guilty，
就还得回到那个小镇上上庭。
第一次吃ticket，不知道认罪好，还是上庭好，主要是离得实在太远了，要是dismiss
可能性不太的话可能就得认罪了
另外，要是上庭的话，非得本人到吗？能找个律师代上不？ |
