reasonable doubt. 有没有那个“a" , 不重要。只要被告，能在一个element上，让控

无罪推定的原则指出判无罪，只需要在控方的证据和逻辑链中找出合理的疑点即可。而
控方的证据和逻辑链必须beyond reasonable doubt，也就是必须有强大的根据。简言

法官和辩方律师都会提醒陪审团doubt，关键还在reasonable。既要有质疑精神，但又

和这个“a reasonable doubt” 不是说“一个” reasonable doubt, 而是说“ a
reasonable person's doubt." 因为这是从古英格兰法律体系里面演习出来的，所以那
个person 就省掉了。
一个reasonable Person 是可以有很多doubt的。 所以beyond reasonable doubt 和
beyond a reasonable doubt 的说法，没有什么区别。 你其实满可以google 一下。。。

。引用一共50+，40+的独立。工程方向，引用很难涨，一年最多增长几个。review 40+
，分布在12个journal，2个conference。公司是上市公司，完全符合1B的条件。
律师：公司指定的老美律师，不能自己选择。组里，包括我在内，同时有3个人提交1B
，都是同一个律师办的。其他2个人，都很顺利。只有我收到了NOID。
最初提交了9个推荐信，7个独立。美国×5，加拿大×2，澳大利亚×1，中国×1。其中
一个美国院士，方向里的大牛，提供了一封很强的推荐信。

9/25在网上查就已经过了，9/26让经理和律师确认一下。9/27早上律师回信说，网上状
态显示过了，但还要等正式通知寄到，然后会把复印件给你。结果9/27下午就收到了复
印件。
背景就不重复了，主贴里有，没什么亮点。最后回复NOID时，用到了esi引用
percentile的统计，我最好的引用也不是top 10%之类的，但是是median引用的3-4倍，
就用这个欺负美国人数学不好。实在是侥幸。
下面是我给律师写的noid response建议，其实也都是从版上学的，也不知她最后用了
多少：
1.从杂志的主页抄下来他们自我吹捧的介绍，highlight一些关键字诸如major advance
, significant implications这类的。
2.用各种方法找杂志排名，用不同的指标。

再多说两句，纯粹从案子的输赢角度来看：
这种刑事案件，控方一定要证明G.Z.的行为的恶劣程度，达到了二级谋杀的标准。
而辩方，甚至不需要证明G.Z.完全地清白无辜，只要提出一些比较让人信服的说辞，让
陪审团对控方的理论产生合情合理的疑问。(reasonable doubt)
那么控方一定要证明G.Z.的那些恶劣行为呢？
1. GZ在事发前后，有伤害TM的主观恶意和敌意。
控方用的最重要的证据是在GZ的报警电话中用了F* Punk这样的词。可是在辩方的盘问
中，现场的警官和审问GZ的探员都作证GZ对TM没流露出任何恨意。相反当听说TM死掉了
，GZ表现得相当震惊难过。(reasonable doubt)
2. GZ对TM抱有种族歧视的态度（这是1的一个变种）。
控方用的最重要的证据是在GZ在以前的多起失窃报警电话中反复形容嫌犯“黑人男性”

了享受doubt么？完全错了。
如果你们错误地在行动上把doubt当成了你们来这个版的目的，那很显然可以理解为
什么你们在这里都不开心了。
