如美国政府不认为自己对印地安人有完全的Jurisdiction，所以宪法14修正案就不适用
于印地安人。直到1924年才推出专门的法律来处理印地安人的出生国籍问题。
美国政府显然没有外国人包括非移的完全的Jurisdiction，所以宪法14修正案其实压根
就没有给予外国人包括非移的出生公民权。

反对出身公民权的行为，无论从历史还是现状来看，都是自绝于华人社区。
先说历史。
美国早期是没有出生公民权的。现在有些人因为反对非法移民在美生子，就叫嚣废除出
生公民权。事实上，美国实行出生公民权之前的那个年代，并不想有些人臆想的那么美
好。那个年代，不仅华人即使出生在美国也没有公民权，而且华人也没有资格出庭作证
，许多华人被白人杀害，凶手却逍遥法外。
出生公民权的实施是多年来无数人斗争的结果。出生公民权是维护公正和平等最简单有
效的方式，不论什么种族，父母来自哪个国家，出生在什么地区或社区，只要出生在美
国领土上就是一样的美国公民。
如果没有了出生公民权，那么出生在美国的人，谁有公民权，谁没有公民权，这个问题
怎么解决？谁说了算？难道还要倒退到过去，白人在美国生的孩子才是美国公民，华人
再美国生的就不是？

"All persons born or naturalized in the United States, and subject to the

注意里面用 and 连接的两个对等条件：出生于美国、接受美国法律管辖。事实上，这
是两个重复、多余的条件 --- 既然出生在美国，当然接受美国法律管辖。何必多此一
举？
1868 的十四修正案的文字出源于 1866 著名的民权法案，它给予解放黑奴的公民权与
法律权。它的文字是这么写的：

是这个臭傻逼，然后意识到卧槽莫非我车头看起来很funny哪里坏掉了，然后下意识带
了脚刹车，然后就过了山头了，刚能看见对面路，看见马路中间一只傻逼elk，一脚刹
车到底离鹿差不多不到100ft停住，要是之前没带刹车估计就够呛了，每次想想都觉得
感谢好心人 |
