petition is pending while the original H1B expired already?
Yes, if the extension petition was timely filed, the H1B worker could
continue to work for the same employer 240 days beyond expiration while
extension petition pending.
Also you can consider using 485 EAD to work. |

材料.
我想现在给他们把绿卡递上(I-485)同时申请返美证(advance parole: I-131).然后父
母就可以在绿卡申请期间回国办所有需要的文件,然后回来也不用签证.
我觉得这样可以,因为网上是这样说的:

I got another question regarding the # shown in I-485 Yearly data. In the
spreadsheet, FY2009 Emp Adj Approval count is 130,352 but in the Yearbook
2009, the employment approval count is 144,034.
130,352 approval counts does not make sense because there is a long queue of
employment applicants waiting for the quota and the annual limit for
employment based is at least 140,000.

Based on the latest VO information about EB1 as well as latest trackitt data
from Q1/Q2, this is the current status and predictions for EB2.
In summary we think that EB2IC will receive total 37K SOFAD of which ~31K
will go towards backlog reduction. This would mean a dates moving into Apr-
2007 for EB2IC. The best case scenario would be Aug 2007. Worst case would
be Sep 2006.

）都可以保留PD。
