等到第15天才联系USCIS，上周末他问出来是RFE:
Specifically, the USCIS is requesting evidence of *****'s employmer-employee
relationship with you, and its right to control and supervise your
activities.
律师让我把offer letter发给他。我就奇怪了，开始申请的时候材料里竟然没有offer
letter???
请问这个RFE好搞定么? 公司是大公司，工作是码工，各方面都很match，实在想不到为
什么会被RFE。 |

其实很早就是"clock stopped"状态了，但是律师一定要到第15天才打电话，最后在第
15天我的追问下打了电话，得到RFE，下面是他的回复：

可是他们没有告诉我我的利息是多少!据说这个利息是市场利息+margin。不知道这个

下来的绿卡和两篇可能不错的文章,前者, 只要你愿意, 以后再来也可以再申请, 而且
eb1b因为不bound to employmer sponsorship,你回去了, 也不等于放弃申请.我就知道
有人回国了几个月, 绿卡批下来, 以后就带着全家每年过来旅游两次维持绿卡的. 至于
你的文章, 如果这边老板比较nice, 可以考虑在国内跟老板合作继续文章相关的研究,
必要时每年过来几个月完成文章. 人生苦短, 你和孩子在一起的时间更短, 个人认为全
家人在一起, 过好每一个今天最重要. 何况你LP看来在国内也很好,没必要过来跟你一
起受苦吧.
另, 拿到绿卡, 也不见得就一定能立马进工业界, 我所在的Bioparmaceutical公司最近
招七个位置, post后一个星期收到近一千封简历, 很多是有公司工作经验的, 他们往往
比从学校出来申请的有一些优势. |

form with H1b indicated when I changed the status.
I just noticed today that in my W-2 form, the Social security/medical care
taxes are all zero. It seems to me that my employer (I work in an university
as a faculty) forgot to take these taxes.
The question is:
Do I owe IRS any social security and medical taxes for my 2008 tax return?
Do I need to pay IRS these taxes when I submit my 2008 tax returns recently?

income "flows-thru" to individual tax returns. diff is S-corp goes on Sch E
and s/p goes on C. 1099 income should be separated from W-2. you get to
deduct biz exp against 1099 income. pay tax (self-employmed & income) on
net profit. $60k won't trigger AMT |

算不算非法打工。从法律上我们并没有找到真正“employment” 的定义是什么。我想
在以前立法的时候，还没有所谓的Internet，所 有的商 业与employment行为都还 是
以传统的方式进行。也就是所谓的打工就是去公司上班赚取薪资。移民局那时没想到现
在的人可以不必去公司上班，就可以在家里上网或利用电话来赚钱。这样算不算是非
法打工呢？在美国没有工作许可的人(家属，或是下班之后)可不可以Self-employed,
赚取生活费呢？
现在的经济与商业体系与形式已经将传统的概念打破。所谓 employment的定义这个恐
怕需要经济学的专家与法学学者才能讨论出来。我们不想为这些伤太多的脑筋。
我只想解决最实 际的问 题，那就是只要你没有去成立一 个公 司，而 且从公 司里领
取报 酬这都是可行的 ，从实际的角度来说CIS是无 法证 明你非法工作。因为CIS是
