警察的工作是：超速就抓，警察的工作不是：你到底为什么超速；那个，是法官的事。
所以在美国，警察抓你，不代表你就是犯了什么罪，警察更没权力直接拿你信用卡刷卡
付罚款，有具体情况跟法官说，如果法官觉得可以理解，那么可以免了你的罚款，这个

你说的，法律上叫做case in chief defense，我说的，是affirmative defense
你想challenge警察的判断，说你压根就没超速，那么好，到底警察和你，到底信谁的
我说的是超速我认了，但是我也是不得已，可不可以少罚一点。
从法律体系上说equitable就是法官掌握尺度，法官尺度管得严，那就是没有可
争辩的，但有时候法官会问你认罪吗？你可以说我有具体情况，孩子病了云云，有时候
法官可能网开一面。
最著名的具体问题具体分析是jury认定voluntary manslaughter成立。15岁的小孩被打
死，被告杀人罪成立但法官判被告不入狱，只判了5年probation，400小时社区劳动
and $500罚款。上诉法院全票一致同意这个判决。法官的这种discretion是很强大的。

好像很轻松，对他们来说也是人生重要转折点，就像你和自己孩子选学校一样。我最近
看了我密一个walk-on QB的勤奋事迹，突然对这些不但品学兼优，而且从来不甘于作陪
练而泄气的球员们肃然起敬。
其实就是不设什么淘汰机制，一样有很多人没有打上主力，自我感觉好，要转学。这些
转学的人（不包括因为教练下课转学的）大部分没有好下场，只有很少一部分的人最后
成功了。
现在的问题在于教练和AD，教练和AD拿着高工资，最终目的就是要拿好成绩，创收。把
学生运动员的培养这一NCAA的宗旨已经摆到一边去了。
我很高兴，我密从来没有这样的教练，这也是我不喜欢Les Miles到我密的原因。你看
这次已经是Les Miles第二次想靠我密提高工资了。最后他没有得逞，因为LSU AD不买
账，说你要么就走，不加工资。Les最后只extend了contract。

应该是那个网站的责任啦，sale of goods governed by uniform commercial code,
contract law里面的unilateral mistake问题，只要是Buyer did not or reasonable
or should not aware of the mistake,seller自己承担错误导致的后果。buyer can
argue比如laptop卖多少钱是比较professional的事情，里面有很多东西外行人是不知
道合理价格的，所以没有证据可以证明buyer是恶意take advantage of seller's
mistake,不过你们这个case,buyer买了5台，这个这个，人家公司会反驳的。你接着要
argue你是善意买了5台，自己想理由去吧。
除非来个class action,几百几千个人一起起诉，要不然一般不会有atty愿意take这个
case的。
先BBB吧，看结果怎么样，完全不赔偿直接cancel这是不对的，至少得来个优惠券安慰
