发帖数: 135 | 47 我女朋友大概一个月前在高速上因为超速，被在她后面骑摩托的警察闪灯了，当时我不
在场。由于她刚拿到驾照且来美国的时间不长，不知道这种情况是要靠边停车，所以警
察闪灯跟了她大概几分钟然后追上去在她窗户旁喊让他靠边停，她才靠边停车。警察自
然不用说了，非常生气，给他开了TICKET，上面有2条罪。 第一条是超速，第二条是
2800.1 vc (a)-Evading a Peace Officer 。开庭日期是3月1号，马上就要到了。 因
为没有任何出庭经验，再加上3月1号她有课，因此给法庭打了电话，要求改日期和要翻
译人员，但是法庭的接线生态度极其恶劣，只说这2个事不归他管。
我简单在网站查了下，主要是第2条罪比较严重，DMV的网站写如果此条罪成立有可
能会被监禁最多1年。我们打算找个律师，请大家给推荐一下专门处理此类案件的律师
，花点钱无所谓，主要是能解决这个事。我虽然来美国有3年了，但是搬来洛杉矶只有
不到一年。对这边的情况和法律也不太懂。请大家出点建议。谢谢。

发帖数: 10121 | 48 先打听看看多少钱吧，evading是比较严重的，其实就是用词吓人。就像红灯右转它也
叫你闯红灯一样。我有个朋友5年前因为这个就罚了300多，那时罚款还都挺便宜的，她
是因为没看见后面的警车开出好久了才看到。

自己交的罚款。
你要按照ticket上的指示联系相关地方。我觉得你说不太在乎钱的话直接出庭辩解一下
试试看好了，不需要找律师。你这个也是没看见，而且时间不会太长。驾驶也不属于故
意的evading，警察没有呼叫dispatcher。。。。

昨天我们去了法庭，过了堂。由于2800.1 vc (a)-Evading a Peace Officer是很严重
的罪，最高处罚是监禁一年。法官很NICE，一开始直接告诉我女朋友I am not gonna
send u to jail.然后才问是否认罪，问法官认罪处罚是什么，罚金是多少。法官不说
。法律程序是只有认了才告诉你处罚。我女朋友认罪。而这时法官很惊讶。什么都不问
了，直接说了一堆废话，然后让她重新考虑。法庭上其他办事的人员拿她的材料让她跟
我商量，是否认罪。我当时的意思就是不知道处罚就不认罪。问法庭上的办事人员他们
只说罚金是a lot。 同时他们也引导我们让我们改口不认罪。最后看我们还在犹豫，他
们几乎就是帮我们决定了，让我们不认罪。法官再次问我女朋友，我女朋友还是想问处
罚（我们的想法是只要是罚钱，数目不是很高就认罪）。而法官这时看她第2次问罚金
，反问她美国月赚多钱，她回 |
