H1B要填的I-129表格并没有问这个问题。没有像申请绿卡时候485表格明确的问的是
have you ever been arrested or not?
所以当时的HIB批了，现在担心申请绿卡时候disclose,会不会被认为H1B申请的时候因
为没有disclose而认为是欺骗行为，主要也是因为case当时dismiss了，也expunged。
关键是现在也忘了当时h1b申请时候是怎么问的了，而uscis网上找到的I-129表格上也
没有类似have you ever been arrested or not? 这样的问法。 |

个charge，但不是conviction。
请问熟悉公司招聘流程的前辈，请问我这种情况现在可以在加州找工作吗？如果做背景

律师就说，dismiss掉可能，有可能还是infraction，有可能要trial。如果是后2者，
可以过1年2年再expungement。但是期间，不知道雇主看到infraction，或者是
misdemeanor，收回offer的可能有多大？有当HR的同胞来说说么？
还有，就是，律师貌似说infraction是court之内纪录的，不会被背景调查公司access
到。是么？ |

最近本人因各种事交织到一起（第二个孩子刚出生的第9天），不想把小孩的午饭后的
午休打断，又想赶快买点孩子的牛奶鸡蛋，从而未想的远些，导致一时疏忽，在（德州
）Wal-mart停车场把自己两岁多的孩子一个人留在汽车里睡觉大约15分钟，（室外温度
大约55F, 车窗也留拉一点缝以防止窒息）。 结果被人举报，而受到警察犯罪指控 (
Felony Charge)。罪名是遗弃及危害儿童并有返回意图，可导致儿童窒息或被绑架 （
abandonment and endangerment of children with intent of return, suffocating
and kidnapping）。因为此事，当天已在监狱呆了20小时，目前属于保释阶段（来美国
１４年，也算有了进监狱的经历和教训）。最幸运的最重要的还是孩子没有任何伤害。
若被定罪，最重可获得6个月到2年的州立监狱刑期及永久犯罪记录， 自然就会严重影
响到移民身份和工作/职业发展。
现在法律程序已进入到刑事诉讼的大陪审团（Grand Jury）的阶段。目前辩护律师解释
