没有小孩，但是abortion过， 这个可以提吗？

submit the I130 while in the US under B2.
remember that B visa has no immigration intent, which means that if you
submit I130 while coming under B2 , will have a higher chance to be

share insurance account, put beneficiary of your life insurance to your
wife and vice versa. Any evidence to demonstrate your marriage bona fide

I-864: Affidavit of Support,不需要,这个是和I-485一起作为I-485的支持文件.
Evidence for bona fides of marriage: 感觉边缘证据太多,没意义,挑重点的,象有孩
子的孩子的出生纸,联合银行帐号给一两份statements,等等,类似证据过多,会分散处理
人的注意力.
I-485:
Copy of passport identity page, visa, I-94, SSN;有要求SSN COPY吗?感觉在表里
填清楚SSN就可以了.
Copy of 3 month paystub;三月的PAYSTUB太多了,建议抽几张不同时代的PAYSTUB就可
以了.

的，因为你是1B, 正常情况下要求有Bona Fide, 雇主可以以这个来搞。当然，目前还

分享一下背景和timeline：
EB1B，两年前香港博士毕业，CS中某小众专业。Paper共11篇，其中5篇是领域内顶级期
刊，4篇一作。Citation大概80，其中60%是行业内排名前5的刊物。审稿不到20篇，领
域内中小型会议做Program Committee两次。paper中有两项结果在工业界有应用（都找
了推荐人来证实）。推荐信一共找了7个人写，其中5个是独立推荐人，基本上是大学教
授或者工业界的researcher。
公司请的律师完全不靠谱（还不能自己找），一开始咬定刚毕业的PhD不能申EB1B，被
我花了很多功夫去说服，终于同意试试看。准备的过程很痛苦，因为管事的律师没经验
（基本上都是assistant paralegal来干活的，大律师只是最终legal review一下），
材料全都是自己组织准备，零零碎碎花了多半年时间，推荐信也全是自己写的草稿再找

副申请人被RFE 婚姻的bona fide
背景: 副申请人和主申请人在结婚前异地(读书), 结婚后两个月搬到一起
递485的时候结婚不到十个月,交了结婚证明和joint tax return
比较麻烦的是发觉证据不多
我们有joint residence, 是主申请人结婚前买的房子
因为州法律规定结婚了就是共同财产, 所以也没有去改ownership of property
所有帐单都是主申请人的名字 --> 这个不知道改了有用吗?
也没有joint account, 因为副申请人没有收入
都是主申请人刷信用卡
没有小孩
能想到的证据是:
车保险是两个人的名字
主申请人的life insurance受益人是副申请人和主申请人父亲的名字(各50%)--> 会有
问题吗?
有很多两个人的照片
以前异地一年多有十几张机票
还有几个月前想买投资房, 下了几个offer都是联名的, 不过没有买到, 不知道有没有用
我很不喜欢现在办485的律师, 在办140的时候就很不给力

退了，所以现在有三种打算。我对移民方面了解不多，道听途说一些东西，跟这里的大
侠咨询求证一下。
1. 现在马上结婚，然后马上一起交485。公司说勉强来得及。但我有几个顾虑， 第一
，女朋友是F1，9月份才开学，以前也在美国念书，但这次是一个新的program, 新的
visa. 这样她刚来几天，还没有开学就结婚申卡，会不会被当作fraud被拒？另外，这
样势必结婚比较仓促，基本就是领个证，这样bona fide marriage evidence 会不会不
足? 既没有靠谱的婚礼照片，也没有时间把地址，保险，账户，账单啥的办到一起。
2. 第二种方案就是我现在先交485, 过一两个月我们结婚后我老婆再申。这个好像要求
她申的时候我的PD又current了而且我的485还没有approve. 这样有没有可能过一段时
间我的都approve了但因为PD没有current过所以她没法申（我真的不懂，如果犯了常识
性错误，请轻拍）。如果这样她是不是就没法跟我一起申了。

2) 申请e-verify对公司规模及是否与tech有关没有硬性规定。
3）雇满8个h1b之前，对外籍员工人数及比例执行中不会苛求。
4）没有报税记录的新公司也能申请。但对你是bona fide business及有能力pay这名员
工的evidence burden要求不低。而且还得证明他是专业人士，不是什么碎催的活都干。 |

一开始公司律师不愿意给办eb1b因为人家觉得不qualified. arguer了很久才勉强答应
并且及其不上心.140 partition letter一共8页并且模板气质严重.要求先file后pp也
被拒绝.
140之后才结的婚,结婚后马上交485,交485的时候准备了一堆Bona Fide Marriage
Documents,还好没被为难也没有interview.
媳妇是党员,并且到现在才出国不到3年,当时填的时候根本没想就选了党员还上了模板
声明,最后也没被为难.看来这东西主要是看运气.
485交了俩半月EAD/AP都没动静,看着前后左右的EAD/AP都批了,就做了个online SR,没
想到直接批了485 deny了其他俩.
一把鼻涕一把眼泪的从本版毕业了,最后祝大家好运!! |

副申请人收到RFE，要求证明marriage bona fide。
提交485的时候，刚刚结婚一年，而且这一年中还不住在一起，所以对这个RFE也没有太
意外。
今天刚刚寄出RFE材料。
1.joint tax return for 2014 and 2015，从IRS要的copy。
2. copy of apartment lease contract.
3. medical insurance records，上面显示LD是我的beneficiary。
4.医生证明显示LD怀孕了。
5. Copy of receipts for flight and hotel for our latest traveling in Dec-
2015，证明旅游住在一块儿。
6.Copy of credit card statements 显示咱俩地址一样，而且互相为对方的
authorized user.
