话，这个周二参议院将作决定性的投票，是否禁止关于法官提名的filibuster。
filibuster是一个参议院少数派（现在是民主党）可以动用的合乎宪法的手段，来阻碍某
项投票，从而阻止某个法案或总统提名的通过。它一定程度上修正或补充了“少数服从多
数”的议会政治，保证一些极具争议的政策或提名不会因为一个简单多数的投票而通过。
这场争议因布什的最高法院法官提名而起。最高法院可能是现在民主党在华盛顿唯一一个
说了算的地方，这使得希望推进很多保守政策（禁止同性恋结婚，禁止堕胎等等）的布什
十分懊恼。就像1937年的罗斯福，布什的对策就是给最高法院换血。条件也允许，因为跟
1937年的情况一样，有若干个最高法院法官已经快要退休。
但是布什的提名遭到民主党的一致反对。作为少数派，民主党唯一能做的就是用fili
buster来阻止投票。于是共和党提出废除关于法官提名的filibuster，可谓釜底抽薪。

法院的提名，要是人选合格，两党基本放弃 “政治”理念，以 提名 judge 的 record
为主。
比如 scallia 和 那个liberal 老太太都是 95 votes confirmation。
但也有非常 controversial，像 黑人大法官 Thomas，只有 52 conformation in 1991。
但是，03年，主党非常气愤 00年大选，几乎和现在一样，认为 小bush 没赢，所以 搞
了一个 filibuster，60 votes，
估计这也是 bush 没法提名 “纯” 保守的 大法官，bush 提的在一些问题上，后来
有 liberal 倾向。
后来 Reid 在 奥巴 当选后，又取消这个，只留下了 大法官的。
所以，谁在gaming the system 一目了然，主党是 我赢了 玩一套，我输了 在玩一套
，对 体制/法律 本身其实 根本不尊敬，只想利用。
主党这样下去，会玩坏 底线，政治斗争可以有 立场先，可以不讲是非，但要有底线，
