刑事案的被告，最聪明省时省钱保守不折腾的做法就是：
1. 任何有关自己姓名，确认ID的最少信息可以提供。
2. 对其它问题就引用米国宪法修正法第五条不回答的权力。
“I [hereby] claim and assert my Fifth Amendment
Right against self-incrimination."
结果自然是盘问过程很快结束，被控方没提供任何额外信息，
除了ID, 但回答那问题不大。没证据或证据不足下自然无恙。
坚持立场非常重要，因为一旦开始提供信息，就等于放弃权力。
至少控方会这么说，法官也可能赞同。控方必会借突破口发挥。

停了上百米。结果周围的住户给警察打电话，警察叫拖车公司的人来一辆辆拖走。我回
去车里取东西的时候正好拖车公司的人把我的车架起来了准备拖走，警察在指挥。我让
他们停下，结果警察说我的车一个轮胎压到了白线，所以给了我ticket.我停车的时候
专门留意了，尽量往里停了，最多只是压线，肯定没有出线到路上来。
当时警察说，我只有两个选择，一个是现在给拖车的人180美元，这样拖车的人把车还
给我，不给我拖走。另外一个是不给钱，让他拖走，然后交更多的钱。我说我要回去取
钱包，然后拖车的人让我把车钥匙给他。我当时没多想，也怕他拖走，就把车钥匙给他
了（事后想了想，觉得也许不该给他）。然后我回去给了他划了信用卡并签名。这时候
警察的罚单已经开了，所以我知道罚单肯定不能除去了。
这时候周围的住户出来了，一个白人大妈，冲着我大骂，说她got tired of so many

我们的车被撞了，叫了警察，当场警察给对方ticket，我们没ticket，对方保险公司也
同意赔偿所有损失。可是今天突然收到court的一张单子，写着“change in court
date. You are hereby notified that the court matter(s),listed below, has
been rescheduled for 01/28/2013 above", 然后底下列着violation的时间和条款 （
我查了，是careless driving），violation name是对方的名字。
传单上还写着，witness for state copy. 难度我们是去当witness? 我们的车被撞的
时候，我们的确在车上。可是我们不是受害者么？难道是对方不服警察判决，然后上诉
，法庭要我们去当witness?
这是啥情况阿？怎么处理呢？我们在New Jersey. |
