Hopwood一案之后，德州大学禁止考虑种族。德州议会才推出588法案，既不和该案冲突
，也照顾到了各学区，还能考虑多样化。这里的多样化当然不是指种族。如果议会要废
除hopwood一案，直接立法就是。
进一步，就算没有hopwood的这个立法历史，只有猪一样的智商，才会认为法律原文里
会有“照顾种族”这种字眼。这简直是直接招来宪法诉讼。

你一定看过这样一张图。
1874年《人的演化》第一版插图。
这张无敌手绘的作者是恩斯特·海克尔（Ernst Haeckel，1834 - 1919），著名的德国
生物学家、哲学家和艺术家。经他描述并命名的物种成千上万，我们熟悉的很多生物学
词汇，比如“门（phylum）”，“生态学（Ecology）”，“原生动物（protist）”
也都是他的首创。不过他的成就中，我们最熟悉的应该是所谓的“胚胎发育重演论”（
Recapitulation theory）：胚胎发育的阶段和他认为的生物演化的序列是相符合的。

conservative的定义就是反对激进社会变革啊
其实保守派大法官在Fisher案子上的判断，
更接近于反对教育界搞出来的激进的社会变革--AA
认为这种社会变革缺乏社会和法律基础
比如如果你去读Alito的反对意见，
就会发现他反对的AA是98年Top10percent Rule生效之后
UTexas继续搞AA这样“激进”的社会改革
而这种变革其实不过十来年时间，
所以他其实是要恢复04年以前的体系，也就是96年的Hopwood decision
认为这个新AA在Top10percent Rule生效之后已经没有了任何基础
应该保守的退回去。。。
而不是“激进”的改变42州规则，向前走。。。

当前这个规定的diversity里面是明确有race的。

2003年废除了你都不知道，在这里装逼什么法律专家？早就看出来你在装逼了。
我们讨论的是现在的法律里面diversity含不含Race，事实是含的。
而且这个是考虑了EQUALITY UNDER THE LAW以后，最高大法官投票的结果。
而且还跟了解释，明确提到了Race可以考虑。
至于结果是否合理可以讨论，但是当前法律是含有Race因素铁证如山。
赶紧删号。

最简单的补偿做法是按地区设一个加分线。因为不能排除穷地区也有优势种族，富裕地
区也有贫穷种族。
这就是为啥德州在hopwood v. texas 之后，设立头十趴政策能通过的原因。 |
