长移民局长和移民各分部的头儿呢。
成为原告是因为它是集体诉讼，原告包括列名的十几人，不列名的immigrationportal.co
m上的所有成员和他们的家属，以及我们这些同样有I485 Pending的。
如果告成功了，当然所有人都是受益人。不过有人可能会想，反正我的快下来了，还不知
道告到什么时候呢。可是，这毕竟是和我们相同处境的人们的一项权利。如果我们自己都
不在意，怎么能要求别人尊重我们的权利呢。
如果告不成功，当然移民局更可以为所欲为了。而且一事不再理，别人再想告法院还不受
理了呢。

我在递交Relink Request前，曾在网上看到过下面这个Relink Request的Checklist，
列出来供参考:
1. A cover letter explaining what you want to do;
2. Copy of approval notice of the I-140 to link to;
3. Copy of I485 receipt notice;
4. Company offer letter (if your I-140 to link to is a company-sponsored)
5. Payroll record in 2004 and 2005 (just a print-out of all the salary
earnings)
6. A copy of the Michael Pearson Memo.

发帖数: 2278 | 8 我在Relink I485 (一)中提到过IO曾经告诉我SC的官员会自动做所谓的Relink。
但是也有IO告诉我如果想要Relink，就必须submit relink request, SC会把你的
relink request归档到你的case下以便处理你的case的时候参考。
不少寻求relink的人是至少有一个140被批准。
如果另外一个140不幸被denied了，按照某些IO的说法，file在denied的140下的485会
自动转到被批准的140下；但是根据另外的IO的说法，则需submit relink request来延
续485.
不同的IO有不同的答案，让人莫衷一是。
但是申请485的人，至少有一件事情是可以尝试的，那就是在一个140被批准后，
如果485并不是file在这个140下，那么要在另外一个pending的140(可能)被deny之前，
尽快递交Relink的请求信。这里的利弊的权衡就在于如果pending的140如果priority
date比批准的140的更靠前，则Relink 485就可能需要斟酌一下。

所以还是决定再写一篇给“140一个批准一个pending”的状况出个主意。
这里要明确说明：批准的140的PD要早于pending的140的PD，谈relink才有意义。
case senario:
申请人有两个140，EBX和EBY，EBX被批准，而EBY pending, EBX的PD是current或者
是早于EBY的PD，而485 file在EBY之下。
Relink的处理方法：
先递交Relink信要求把485 Relink到EBX下(relink的模板情参考我前面写的文章)。
通过邮局或FEDEX的Tracking确定USCIS收到自己的Relink请求之后，申请人可以考虑撤
销Pending的EBY。按照USCIS的IO的说法，申请人所FILE的资料会被归档在一起，因此
推断RELINK的材料也会和485的申请材料放在一起。
之所以要这么做，原因我在“Relink I485 (三)”的第4段分析了。简单地说，就是
由于申请人提出撤销140，导致USCIS要去处理EBY的case, 由于申请人的485是file在 |

第一次去年12月底交的，1月份被退回来了，理由“排期未到”。在置顶“485被错误退
件”贴里汇报过。
1月19日重新递交，
2月10日收到485收据，
2月17日交了131和765，
3月15日收到FP notice（485和765），
3月17日walk in打指纹，
3月19日EAD card production，
3月24日AP批了，
3月26日收到email 485 card production ordered

我现在的情况就是，因为本专业敏感，是个公司，都需要公民或绿卡，所以没有找到对
口的工作。
因为发的文章还不错，也有审稿经历，律师建议赶快申请EB1a，试一试。
OPT刚开始一段时间，目前还在找工作，联系着一家单位，是有可能找到一个不对口的
工作，是临时的，有可能转正。
我的计划就是，尽快申请绿卡。同时争取这份工作，如果拿到这份不对口的工作，就先
做着。
如果顺利，三个月以后，绿卡申请成功，考虑找博士本专业的工作或者继续做不对口的
这份工作（如果发现自己很喜欢）；如果申请不到绿卡，那还是老老实实，继续做这份
不对口的临时工作。
是不是绿卡申请成功，就意味着你必须做博士专业的相关工作？
感觉很复杂，是不是这个计划存在很多潜在问题？？？
问过老大ladao555, 他说换专业申请，应该没有问题。跟我的律师也确认过，他也说可
以。申请的时候可以不提现在的工作。 但是律师没有提过如果在交I-485时，移民官要
求提供现在的工作证明时，该怎么处理。

给我和我老公
办正式的出生证明的。怎么没想到我儿子的问题！结果人家说我儿子的出生证明没有法
律效力，要求我们补办韩国政府机关承认的出生证。可是我们儿子虽然韩国出生，但是
是中国国籍呀，而且他已经在我们的户口本里面了。
我看补材料的要求就是证明亲子关系。所以我觉得只在国内的派出所补个正式的出生证
明就是了。至于韩国那边，我只能出具原来的出生证明，和他刚出生时在驻韩的中国领
事馆办的旅行证。他出生后，我没有在韩国的任何部门申告过他的出生。
我想我需要给移民局写信特殊说明一下我儿子的情况。
