前者,儿童色情本身,争议也不算大,最近不停报道警察,教师,议员在上儿童色情网站,下
载,储存,有的人的妻子说LG其实是看成人网站不小心点进去的,有的人的儿子说是他自
己看的,不是爹看的..
但儿童的摄影艺术-裸体的,和色情的界限,就很难划分了
强硬的一派和警察认为,儿童不可能有意识能力同意或不同意拍摄裸照,所以所有以艺术
为名的为儿童拍'性感'的照片的行为都是不可容忍的,10多年前一个妇女艺术家为自己
孩子拍照并展览,好象也被判了刑
另一派,通常是艺术家和那些以前被拍而并未觉得受到伤害的人,关键是是否
exploitation(剥削,利用,怎么理解这个词,程度上差别很大),是否lewd(艺术美感和性

诽谤与谩骂的区别， 并且说”骂人是受美国宪法保护的，英文叫做freedom of speech
”, “即便被骂的人有多么的不爽，诉诸法庭也是没有什么用处的”. 感到有点
surprise.
美国宪法First Amendment 的Freedom of speech 要保护的是人们表达思想的自由，而
不是骂人的权利。骂人和表达思想是有本质区别的。
U.S. Supreme Court 在 Chaplinsky v. New Hampshire一案中将骂人和表达思想做了

有人知道这是什么情况吗？是不是曾经在我的隔壁租住过，现在搬走了？还是说跟隔壁
是亲戚关系？ 我随便点开了别的sex offender，注册地址和安放地址都是吻合的。
抛开房子再售时的价格因素，这个房子的安全性如何？还能入手吗？

根据 Wiki 里面关于 Hate Speech 的解说，美国关于种族歧视性言语是比其他国家宽
容的（例如澳洲），非但没有成文法，甚至视为言论自由保护之，除非其言论足以导致
立即危险。最高法院的判决书这么说的：

它明确地列出了违法而且应该处罚的言论的类别，包括诽谤、淫秽等等，但就是没有
hate speech！

insulting or “fighting” words ... ”
另外，你给的那个 case 不是种族歧视言论的案子，而是不安全的工作环境。这跟许多
大公司里的员工告公司一样，他们声称受到不公平待遇（解雇、升迁受阻、薪水太低等
等），只不过其原因是种族（有时候也可能是性别、年纪等等）。注意，他们告的是不
公平待遇，而不是种族歧视言论本身；雇主受罚是因为违反工作平权，而不是因为歧视
！这跟
Kimmel 的例子完全不同，懂了没？
