在审查诽谤案件时，政府作为受害者通常受到的保护最少，因为政府拥有巨大的资源和
影响力，可以通过其它途径保护自己的名誉和利益；知名人物受到的保护其次，而普通
个人受到的保护力度最强，对普通个人的诽谤只须证明不实言论造成损害即可。

美国的言论自由包括两个方面，一个是狭义的言论自由，主要指以语言（包括口头和书
面）为表现形式的思想表达；另一个是表达自由，指包括图画、表演等的以行为（包括
作为和不作为）为表现形式的思想表达。通常所说的言论自由既包括狭义的言论自由，
也包括更广义的表达自由。
言论自由作为宪法确定的人民的基本自由，最高法院对其限制奉行例外原则，即对言论
自由的任何限制必须有清楚的定义和明确的界限，并且严格限定在狭窄的范围内，没有
划入例外的言论和表达都应受到宪法保护。
