马噶德1995年被法官裁定杀死自己两岁儿子的罪名成立，她因此入狱14年，2009年获得假释。当年她被定罪时，使用的主要证据来自时任安省儿科法医的史密斯(Charles Smith)。
安省上诉法院及辩方律师一致同意，当年的审案存在巨大的缺陷。安省上诉法院三名法官还指出，此案由时任儿科法医史密斯提供的法医结论存在巨大错误，其证据误导了当年的陪审团裁定及法院的审案。
安省上诉法院法官认为，参照辩方提供的新证据，患有癫痫的马噶德儿子有可能病发身亡而非遭马噶德杀害。
马噶德在获悉法院裁决后感觉如释重负，她期望自己与五个月大女儿蒂芳妮(Tiffany)生活从此翻开新的一页，她也希望能与1993年被政府带走的两名儿子重新生活在一起。
当年凡因史密斯错误法医鉴定被定罪的人，他们都被剥夺了子女监护权。
史密斯任职安省儿科法医期间，自1991年至2001年之间共有20人因自己年幼儿女死亡案被控罪或被定罪。
