子只是希望告诉一些在婚姻中不幸的姐妹，你的很多权利在美国是有法律保护的。
离婚时如果有任何关于财产，孩子的问题，一定要找专业人士，也就是matrimonial
lawyer解决。像看医生一样，骨头断了要找外科医生。找律师也要对症， 离婚找移民
律师是解决不好问题的。
离婚是很复杂的问题，涉及Child Custody， Alimony， Property Distribution，
Child Support， 有401（K），Enhanced Earning Capacity。
女性，特别是StayHomeMom， 如果对美国法律不了解，就不能保护自己应该得到的权力
和财产。离婚就算没有财产，没有孩子，还可能存在伴侣继承的遗产，401K帐户， 银
行账户，投资帐户， 婚前财产，研究生学位等各种财产的划分。孩子的Custody还存在
Visit，Supervised Visit， 是否能带回国外，或者外州等问题 。如果存在这些问题

正常人有几个愿意老打官司？网上名骗肖传国就是华人官司大王。在美国，
他打了不止5个官司，从1992年打到2007年，十五年如一日，含辛茹苦。
肖和什么人打过官司呢？老婆，监狱长，雇主，路人。没什么人不打，屡战
屡败。
1992年，肖传国的老婆Yuan Wei和肖打到纽约最高民事法庭，打离婚，不是
和平离婚，是有争执的离婚（contested matrimonial）。
1993年，肖传国到纽约Bronx区民事法庭打监狱长(Warden)的官司，可见肖
坐过美国的大牢。（肖做为犯人申请人身保护令(habeas corpus)）
1997年，美国夫妇LUCY AVELENDA CALI 和 ROSS CALI打肖传国的汽车官司，
美国夫妇和肖不过是路人，也打起官司来了。
2001年，肖传国被雇主纽约长岛学院医院撤职，2002年肖传国向纽约南区法
院起诉雇主歧视，败诉。

中国人的传统婚姻观念是“娶妻生子”，婚姻跟“传宗接代”是非常紧密的联系在一起
的。
西方人的传统婚姻观念是“holy matrimony”，婚姻是上帝的祝福。
所以，中国人对同性婚姻的态度一般是“不理解”：同性恋何必结婚？
而西方人最主要的反同势力就是基督徒，认为同性恋是“罪”的基督徒。
我觉得，否定基督教基本是不可能的。但是基督教的教义其实非常灵活，可以变通。
所以要靠进步的基督徒去带动顽固的基督徒，最终的效果是：博爱的上帝也祝福同性婚

但在中国，讨论同性婚姻其实非常缺乏基础，根本成不了气候。

未经你同意就赠与他人（就是他父母），你知道你有权利上法院申请强制令，强制分割
财产 - 就是他给人5000，你就要求留5000给自己，将来离婚还是立遗嘱，他对这5000
想都别想。一旦法院判了，你要立刻把那笔钱存进一个自己独立的帐户，开户时要注明
缘由，这样这个钱就traceable了。
你现在买了房，不是一个很好的选择，你等于把你的15万白送了他一半。matrimonial
home 无论谁出钱，在谁名下，配偶都多少有些权利的。
楼上一个人说的对，下次再发疯，全程录像。只要有证据，只要法院认定是家暴，不用
熬一年时间分局，法院立刻判离，而且有多少孩子都会判给你的。搞不好他连探视孩子

但想想换来的各自追求各自幸福的自由是无价的，才是真正的述求。我要是lz男人，净
身出门，大家刚来美国除了富二官二不都这样吗？而且给小孩子的抚养费是权利要争取
，不是负担。还就怕不要，以后污蔑是父亲出走抛骑弃子了
大妈一定要多劝劝楼主，放这个垃圾股一马。对小孩子的成长环境也好。只要安排得好
，夫妻做不了了，孩子他爸还是孩子他爸，孩子他妈还是孩子他妈，这个是基因定了的。
一般孩子跟女的，不是跟女的有多好，而是女一般的离不娃。让她去带。自己干好事业
是王道，从不讨好的事务中解放出来，对自己对小孩子都好。

有争议的话，多大的争议，多久的婚姻，抚养费，赡养费，财产分割.....
matrimony的律师通常精通家事法，都有retainer fee，一般每个小时250-400，（这是
一般财产的收费，有些财产庞大的，费用会更高）
在纽约州如果有财产争议的离婚，几乎是要扒掉一层皮的，很大一部分钱都给双方的律
师赚去了，主要因为纽约州判离婚的法官，除了小孩的抚养权抚养费这个问题，其他问
题几乎是倾向于让你们双方自己达成和解，不然就是拖你们自己的时间和律师费，通常
有争议的离婚要解决在6个月到2年之间 |
