所以我的理解就是：原雇主在485 pending 180天内申请撤销140，你485就会被拒。所
以关键是不能让原雇主在你离职后马上撤140（不是所有雇主都会撤140），至于RFE要
拖过180天相对来说就好办多了。
可以看一下USCIS的Memoranda，其中Part I Question 10说了不会因为180天内换工作
就一定会拒，而Question 11明确说了140在485 pending 180天内被撤就不能再用了。

AC21 106(a)和AC21 104(c) 适用于延期H-1B：
AC21 106(a):如果你的140没有被批准，且pending 365天，可以在6年以外一年一年的
延期。
AC21 104(c):如果你的140批准了，可以在H-1B 6年后3年3年的延期
在你H-1B 6年期满前，不管你的140是否被批准了，你应该都可以transfer H-1B,批准
以后，新的h-1b 沿用你原来公司的expiration.所以当务之急是要transfer H-1B。H-
1B transfer 应该不需要140approved.
AC21 106(c)适用于你的485 portability,和H-1B没关系:
我的猜测是，你可以用EAD，不过要等到你485pending 180,而且140批准了才能file
AC21 106(c)。AC21 106（c)就是新公司给移民局写一封类似EVL的信，这个是继续你的
绿卡申请，file这个没有deadline。
如果你离职了，不知道你的140还会不会被批准，这个你得好好问问律师。公司一般不

头的工作，有另外一家公司（profit）找我做part-time。
但是我的申请材料还没有递出去，我电话问律师是不是就不用再递交了。
律师告诉我，我现在在学校里头的cap-exempt h1b，只要没有被辞退，仍然可以申请并
行的cap-subject h1b。有点疑惑，上网查，结果很多，很多都说cap没有了就不能申请
了。

美国移民局发言人（Chief of Media Relations，直译为媒体关系负责人）Jonathan
Withington最近专门向媒体澄清：第一，美国移民局目前没有考虑改变关于H-1B延期的
政策，没有考虑改变对于AC21法律的104(c)条款的解释 ---- 该法律条款允许一些人持
有H-1B工作签证身份超过六年。第二，即便有上述的政策改变（这里用的是虚拟语气，
代表没有真正发生的事物，就像“如果我是你”），雇主仍然可以用AC21法律的106(a)
(b)条款来申请延期H-1B。
