人在美国不能上的致命弱点。 NCCAP就有自己的律师部门，能搞，不断可以起诉，当年
民权运动，Brown vs. Board of Education，最高法院判了后，很多地方不执行，
NAACP的律师部门在全国几百个学区起诉，要求执行，这种耐心，华人根本比不上，也
没有人愿意做。华人读法律的，绝大多数都做商法去了，其实就是赚钱，不能影响大局。
在白人眼里，觉得华人软弱可欺负，所以陪审团不怕，也不一定公正。如果黑人，陪审
团会害怕不公正，因为黑人会闹。并且最重要的，有一大批黑人律师可以打官司，当年
OJ的案子，OJ的黑人律师删掉多少潜在白人陪审团，就找对OJ可能同情的人。否则OJ怎
么可能被无罪释放？
我去过陪审团面试审核过场，双方律师面试潜在陪审员，必须双方律师都同意，但是自
己律师就是要删掉对自己顾客可能不利的陪审员。 如果给华人辩护的律师有魄力，就
会把红脖子，文化低，潜在共和党的全找茬删掉，留下对华人同情的，那样才有希望赢

犹太人以前在全世界被歧视，190x年大规模来美国后，也被歧视，一直到犹太人团体在
全美国考察自己人，挑选有可能竞选成功的犹太人，打电话鼓励他们竞选，团队在后面
出钱出力，一直到不少人做州议员，国会议员，参议员，然后Harvard，Yale，Ivy的学
校才把犹太人的quota去掉。随后犹太人在职场玻璃顶去掉。
黑人以前是奴隶，先是南北战争解放，还是被歧视，后来一直到民权运动，政治上参选
，国会议员，参议员等等，改变法律，让法律保护黑人，随后在职场上只要达到一定标
准，就被录取，并且被联邦保护，各个公司都搞diversity雇人。NAACP还有专门的律师
所，碰到什么事，就免费打官司，搞死对方。
总之，在美国，少数民族要出头，最终还是必须在政治上有大规模人做到国会议员，参
议员，州长助理，州议会，光有钱没用。

在遭到主体民众抛弃之后，这个国家（政治地区）、这个联盟的统治集团也必然垮台崩
溃而不可能指望受惠于他们的其他族群鼎力支持，因为在他们政策下“多闹多得”的族
群只是把他们当作不劳而获汲取不成比例政治经济资源的工具，而无论个人还是群体，
都不可能对自己能够呼来喝去、用以不劳而获攫取资源的工具产生任何忠诚，只可能用
完之后弃若敝屣，而形形色色的优惠扶植政策只是增强了他们汲取的能力与胃口。
一旦依靠部分真实构建起来的多元文化史观和相应政治观主宰社会，使得各少数族裔不
是靠认同主流文化传统而赢得上升渠道，而是依靠认同不同于主流文化传统的少数身份
而更能赢得上升机会，美国社会的统一能力也就开始动摇了。受逆向歧视、担忧国家性
质根本颠覆的美国传统主体民众大批抛弃“政治正确”的“建制派”政客，转而支持特

据哥伦比亚广播公司报道，7月15日（周日），加州民主党以压倒性多数票通过了第10
号法案，即全州范围内的“可负担住房法”（Affordable Housing Act）。该法案将废
除反租金管制的“哥斯达霍金斯房租管制法案”（Costa-Hawkins Rental Housing Act
），把监管租金的权力交还给当地社区。
“哥斯达霍金斯房租管制法案”于1995年制定。该法案规定，凡1995年后建造的公寓或
独立屋，地方的市、县府无权管制其房租。该法案还允许房东在租赁单元空置时随意提
高租金。
第10号法案获得的支持票数超过了60%的通过门槛，赢得了在今年11月6日大选中民主党

本系列第一篇回顾了华人和其他少数族裔所遭遇的警察暴力及其之后的司法不公， 通
过分析揭示这些现象背后的种族歧视意识。
那么在美国，种族歧视的根源在哪里呢？在此不得不对奴隶制作一些回顾和分析。认真
研讨了美国历史，深入了解了奴隶制之后，笔者认为奴隶制可以说是美国的一个原罪。
何出此言？且让我们回顾一下1787年夏天在费城举行的宪法会议。
在启蒙主义的影响下，18世纪后半期欧洲许多国家都已经开始废除奴隶制。但是当13个
殖民州的会议代表齐聚费城的时候，北部七个自由州（Free States）认为奴隶制是不
道德的，违背了独立宣言的建国理念，要求尽快废除奴隶制，但是南部六个奴隶制州（

In September, Public Policy Polling found just 23% of Florida black voters

最近Attorney General也是黑人Eric Holder在NAACP說的那番話也要中肯得多。
這個案子之所以牽涉到種族，是從事件發生之后奧巴馬個人的錯誤，
在弄清案件發生始末之前，他說如果我有兒子，可能就長那樣。
一個法律范疇的案件，被他拉到政治事件的陣營。
這與去年他面臨大選有很大的關系，
于是不管白人還是黑人，面對這個案件都不淡定了。
一年以后的判決結果是基于法理的判定。
判定本身是沒有問題的，有問題的是佛羅里達州的刑罰中，
正當防衛沒有要求 duty to retreat。

Duty to retreat 要求被攻擊方如果有機會退回到安全地帶，
而且沒有合理理由相信對方使用殺傷性的工具或武器，
被攻擊方必須退避，放棄使用武力。
俗話說，人命大過天，在法理的范疇，
duty to retreat 就是過度自衛的一個限制。
