帮国内的父母打听，这个在国内卖得非常贵，一小瓶就几百元，一盒要几千（具体多少
我忘了），据说还卖得特火。因为这药产自美国，我父母就想是不是从美国直接买会便
宜些。
我看了一下他们的网站，感觉不太靠谱，网上关于这种保健品的信息也很单一。我都查
不到它的价格。 |

没有不同的dose 怎么能找到MTD？ 当你有一个NCE时，你用不同的dose找到MTD，当你
有几个NCE时，你用几个NCE不同的dose找到他们组合的MTD。几个NCE，你用几个NCE不
同的dose找到他们的MTD。你不能固定几个NCE而只测量一个NCE的不同doses，你没有其
它NCE在人体的数据，只有pre-clinical 的数据。所以，你应该找出它们在不同组合
doses 在人 的MTD。
是不是FDA 要求你做，因为没人做过，我不知道。我只能根据当人们做一个NCE 时的情
况，你能说出那个在 I& II trial就用一个dose 的吗？没有人作过multiple NCEs

发帖数: 522 | 11 专利与data exclusivity是分开的。专利是USPTO的事情，1995年6月7日之前file的专
利，过期有两种算法，一种是20年from priority date，一种是17年from approval
date，哪种长就是哪个，所以大家会看到所谓的submarine 专利。对于药物的专利，存
在专利延期的问题（Patent term extension, PTE，在美国，基本只有化合物专利，用
途专利可以被延期，通常只能选一个，有很多特殊情况就不说了).
Data exclusivity是FDA的事情，跟专利不应该混在一起。现在基本的情况是，如果是
个NCE或者ODE（哪个长算哪个），如果完全没专利，NCE或ODE结束，保护期也就结束了
，理论上generic可以卖了。如果有专利，被延期那个专利最长（被延期后）不能超过
14年。最少呢，因为最早只能NCE-1 file，file以后进入30 months stay (从NCE开始
算），所以一个NCE，如果有专利，无论这个专利是否valid，至少是7年半保护期，然

12号到14号NCE要宣布，如果通过，就20-30，不通过就11了，加仓
如果NCE再推迟，就不很妙。
商品上市定的是新年，十二月中旬应该被买断，要不这次推迟生产线招人就毫无意义的
败笔了。本人估计12-15号要被买断。买断价24without NCE,35with NCE.
AMRN, 老总没有时间等了。。。。
不过，这斯如果12号后自负的不卖公司就傻了，股票要回个位数。

发帖数: 522 | 13 这种一般是所谓的non-NCE PIV。NCE如果file PIV，最早只能NCE-1 (NCE过期前一年，
也就是批准4年以后），但是作为新的formulation (象那些XR),新的脂，新的盐，和没
有完全重新做临床用于新的indication的enantiomer，这些non-NCE, 理论上批下来的
第一天就可以file ANDA and PIV。为了抢First-to-File,大家常用的办法就是根据公
布的信息（专利，文章.....)去猜那个药的formulation, PK.....一般都是在PDUFA
Date(brand 批准的时间）之前几个月就把exhibit batch做好，开始stability，甚至
做点pilot biostudy，有的甚至做几个不同的formulation，等RLD可以买到，马上去测
测看dissolution,然后挑出最合适的那个去做BE。过了，马上就file。我见到的最快的
例子大概是在brand批准下来以后40天左右ANDA（因为做BE什么的还是要时间的）就

FDA 要怎么做是它的事，我只是说如此一来很多病治不了。正常的思路应该FDA认清自
己的问题，想办法解决问题。FDA 的规矩是人定的，是为人服务的，人是可以改规矩的。
“Gilead最新的HIV药，他们称为Quad，一共四个有效成分，其中两个是NCE，分别为
Elvitegravir和cobicistat。另外两个成分是emtricitabine和tenofovir disoproxil
fumarate。这个NDA已经被FDA接受，而且很可能会批准。这不只是个例，只要愿意找，
可以找到更多。
HIV是我说的2类病，另外两个成分emtricitabine和tenofovir disoproxil
fumarate 已证明对它有效，在加上Elvitegravir和cobicistat 有多少benefit。 而且

我没有批驳FDA，只不过是指出目前发展新药的方法对第三类病无效。

FDA那帮人拍个脑袋就出来的，而是反复与学术界和工业界进行沟通，最后权衡的结果
，这个过程很长，如果楼主亲身经历过，就会知道这个过程中的辩论是非常激烈的。很多时
候，最后是学术界，工业界的权威组成的panel投票决定的。也就是说，任何FDA现行的
规则，不仅仅是代表FDA本身这个机构的立场，而是代表整个学术界工业界现在可以接

我此文的目的就是说在制定FDA guideline时，学术界和工业界和FDA都没考虑到第三类

第三类疾病一词是我的发明， 它的定义我在文章中已经很清楚了。具体的来说就是在
种病，如用不同化合物单独用没有治疗效果，而只有几种化合物同时作用才能有理想的
治疗效果。可以说部分基于想象，部分基于现实。现实是目前FDA的TRIAL就一个NCE，
而还有很多不治之症，我想象可能这些不治之症中有一些可能需要两种以上的NCE，而
当其中的每一个NCE作用时无效。而目前为止，没有两种以上的NCE作的TRIAL，那就无
法知道那个病是第三类疾病。
“2. 临床二期也只是小规模，和临床三期的对象数量上有很大差别，而且通过临床二期
实验的药物并不是在临床三期就不考虑安全性了。 三期对实验对象的年龄，种族，性
别都会给予考虑，这也是对药物安全性很重要的一个方面。只是一个简单的二期并不能
保证药品的安全性。很多药物甚至上市后很多年才发现有严重的安全问题。比如
Accutane对孕妇胎儿的致畸性，二期，三期都不可能用孕妇作为临床对象，这样的PTD

I said that it takes $1.5 B to bring a NCE to the market, sales and
marketing could cost more, if what you said true.
It definetely costs more for 2 or more NCEs in trials. It depends how trails
designed.
If cost is too high, the patients will be less likely to pay it. Drug
companies will sell less drugs, and might lose money. FDA dose not care, but
drug companies do.

以目前FDA规定生产出的药物有一个条件：即对于某一个病来说，要有一个或几个化合
物能够治这个病， 而且它们每一个都能通过安全性和有效性检验，如果任何一个病如
需要两种或两种以上化合物，而化合物中并不是每一个能通过有效性检验，那这个病就
无法治愈或治疗效果不好。
比如说每个肿瘤需要化合物A 和 B 才能根治或有良好的治疗效果，可能有三种情况：
1）化合物A 通过三期安全和有效性检验，已经上市。而化合物B 没有通过三期实验，
它可能是安全的，但效果不佳，没有被批准上市。所以化合物A 和 B就永远碰不到一起。
2) 在某种极特殊的情况下，化合物A 已经上市，人们用A + B 与B 作比较，这样人们

，你的小孩基本上拿不到need based scholarship。而merit based scholarship相对
少太多了。你知道美国大学平均4年毕业率有多低吗？不是学生不努力，很多学生都在
课余打工，有时候还要辍学1-2个学期赚钱。
以harvard为例子，你看一下net price，就是说，父母收入越高，学生能享受到的奖学
金越低。而且不成线性比例。家庭年收入7万以下的上哈佛，除去奖学金只要几千学费
；11万以上的，除去奖学金要3万美元学费！！！

你可以说，我娃去个州立大学，便宜。以Michigan State University为例子，这个学

过去一年多以来，有关美国投资移民EB-5项目可能要发生变化的声音一直不绝于耳，国
会也依旧在辩论新法案，重大改革势在必行。联邦宪报于1月13日公布国土安全部的投
资移民签证EB-5规定修改建议，并征求公众意见。建议中的新规定将申请移民签证的最
低标准投资金额从100万美元提高到180万美元，将目标就业区（TEA）最低投资标准从
50万美元提高到135万美元。投资金额增加将保证该项目要求现在的投资数额相当于
1990年国会制订该规定时的价值。

国安部建议将美国投资移民最低投资额从100万美金上涨到180万美金，上涨率为80%。

HZNP: if you believe the approval price should be $9-10, then after 20min
dilution the optimum price should be about 9x33.7/55.7= 5.65 or 10x33.7/55.7
=6.28. So its price could go lower plus short seller.
AMRN: It's price will come back. I think buy-out is most likely in very near
term (after NCE news). Due to huge market potential billion blockbuster and

Delay somehow means it will get NCE from FDA by mid Sep.
AMRN is already at the bottom, low could be $10 but any positive news on
patent or buyout could go above $17.
Anything could happen. Small position and decided to go long with it. No
plan to hire sales untill Oct is kind of very uncommon in bio-pharma after
approval. For example, AEGR already started to build its sale team for
