美联社奥本尼23日电：根据纽约州最高法院的裁决，膝上舞(Lap Dance)由于不像
芭蕾舞或其他艺术活动一样在社区推广文化，所以应该需要课税。
最高法院23日以4比3的接近比数作出决定，而持反对意见的法官认为，州法律并没
有区别出甚么是「高档舞和低档舞」，并指今次案件提出了重大的宪法问题。
今次案件是由于在奥本尼郊区的Nite Moves俱乐部(见右图)提出诉讼，指脱衣舞俱
乐部和私人舞蹈的收费应否获豁免销售税。
法院多数认为，许多娱乐场所也应征收销售税，如游乐场和体育赛事，并指俱乐部
未能证明具有议会豁免中如「戏剧或音乐表演」般，有促进当地社区的文化和艺术表演
的明显目的。
俱乐部的律师麦卡洛表示，他和他的当事人对于法官的裁决深感失望。
多数法官意见指出，如果有复杂编舞的花式滑冰表演也不符合免税资格的话，那么
「女子在杆上跟着音乐扭动」不能豁免销售税也非不合理。
持反对意见的法官史密斯写道，这是有关法律法规的说法问题。该法定义「戏剧或
音乐艺术入场费」为「现场戏剧、舞蹈或音乐表演」，因此Nite Moves的女子是在跳舞。
