1. 事情经过是这样的：
2月1号周三晚上6时在洛杉矶到旧金山之间的1号高速公路上被警察拦下来
当时天全黑了，路比较直，路上都没车，又赶时间就没注意开快了
路上限速是55，因为黑夜看不清楚，警察写我开了110 （当时速度表应该是接近100mile）
罚单具体内容: 22348(B) VC Exceed 100MPH I (Infraction, 还有一个选项是
misdemeanor)
要我2月29日去 SLO(San Luis Obispo) Superior Court上庭
罚单上也没写明罚款数额
2. 我的情况是：
我拿的是中国驾照（有一些英文翻译），租的Hertz的车，自己没有车。警察让我出示
了我的中国驾照，也没有记录无证驾驶。也没有要求我出示护照。我拿的是L1签证，没
有绿卡或者保险。之前开车三年，在美国开车加起来14个月，从没有出过事故或者不良
记录。
我当时一再跟警察求情，说我不了解这里的法律，请他放了我，但是警察还是不理会，

1.你当时停车，是为了给别人治病（doctor's privilege）or你自己犯心脏病就诊or你
车上有心脏病病人，而且不停那个地方病人就死了；
2.你当时没有行为能力，例如你精神病发作，unable to comply，这在法律上也是好的
defense
3.停车场附近100%的时间有人抢劫，而且专抢硬币，所以100%不可能有人可以拥有硬币
付费，这个在法律上叫做impossibility to comply，这个parking管理公司的内部memo
上曾经写过：这个地方不可能有人有足够硬币付款，我们主要靠拖车来赚钱；
4.这个parking管理公司没有权利在此地收费，例如当地城市的ordinances说凡是装

着两张罚单跟我说让我上法庭，带着保险。第二张车灯坏的罚单让我拍一张坏掉车灯的
照片和修完之后的照片，去上法庭。
这个言下之意是只要修完拍个照是不是不用交罚金了？然后保险那个罚单上写着 "
violation of financial responsibility ordinance". 打算明天去city hall问下价
格，在此之前有懂行的告诉我这个贵么？以前有个朋友也被开了张没有保险的罚单，最

violating any law or ordinance, excluding traffic violations.
USCIS很明确的说了交通违章被抓的不算，管你州里面算啥。另外，traffic
violations就是一种crime。只是USCIS把这种crime从绿卡申请inadmissible的依据中
排除了而已。 |
