个人看法：首先EB1B claim两项就可以了。除非背景特别强，claim三项。你的
publication 和 citation都比较弱，不应该单独claim authorship。从你的情况来看
，应该claim 1. Contribution (把所有能放到这里都放上)；2. Review。

区别是我是1a，claim了review，contribution和authorship，只承认了review
没有claim award和media report，结果同样的列了很长的说只有国家级奖才算
news也要求给circulation这些，contribution和authorship要的东西也一样
感情RFE也是直接套模板来着

审稿：40次
引用：总共80，独立引用只有40吧

律师的助手说推荐信稍微更新一下，如果没有大改的话，我就可以直接发给推荐人要求
签字了。
现在的问题是，
1. 原来的O1推荐信有的提到“alien of extraordinary ability"这样的字眼，是不是
都该删除或者用outstanding researcher这样的字眼来代替？
2. 推荐信最后是必须要打印出来签字的还是e-copy就可以？
3. 律师发的推荐信写作要求中提到
The letters should be on letterhead (if possible) and should not mention
USCIS or the outstanding researcher petition specifically. Each letter
should be addressed "To Whom It May Concern” and should be drafted as an "
expert opinion letter".

。审稿60多，独立引用30~40，所有引用60多。做了十几个会议的 program committee
member。
我自己觉得推荐信还好：2 个IEEE FELLOW，几个Professor。
NSC承认了两项：authorship, judgment work。但是认为

关于这个帖子的问题，我可以给些建议，因为我很了解这个过程。但是是大学的，公司
是个啥情况，我就不晓得了。既然LZ说道只给staff，应该是差不多的情况。
首先，大部分大学是不会sponsor postdoc的，因为postdoc是temporay职位，你第一步
必须跟你的老板谈，他同意你转掉你的title就可以。我们学校的律师说，只要不是
postdoc，其他不管是staff还是faculty的任何title学校都推荐，当然是满足eb1b的条
件情况，而且跟合同期无关，我们都是一年一签的，律师说，只要你申请的时候是在合
同期内就行了。
第二步，老板同意后报到系里然后重新签合同转title，然后重新renw H1B；这里注意
：必须重新申请H1B renew的；
第三步，新的H1B下来后，正式拿到797，你就可以找学校律师了，当然之前你的老板得

一小段（3行）提到我的工作，“xxx could be considered an outstanding
researcher of extraordinary ability, as he appears to have proposed ...
method that ...."
拿不准 "could be.."是什么意思啊，“xxx 可能是outstanding researcher?"，在最
后一段他又说"I believe xxx is an outstanding researcher."
这样的推荐信不知道能不能用啊，已经要求对方改过一次了，第一次只有多半页，也没

Background
材料/化学/电子方向，国内博士，博后2.5年，现美国20-30名大学博后。
40篇文章，一作10篇，全部英文，IF从2-40左右。一作IF>10的大概6篇左右，合作论文
中有2篇Nature子刊。论文大部分发表在Top 0.1-Top 1%的期刊上(based on total
citations)。在PL中99%的地方在讲第一作者的工作。我觉得讲合作的论文也是可以的
，但懒得去挖掘合作论文中的亮点了。好在第一作者的论文也有很多亮点。
引用：大概2000次左右。合作的论文中有几篇hot topic的文章，单篇引用好几个都在
300+。自己一作文章被引大概300次左右，有一篇100+。一作文章中有一篇被大牛写了
专门的2页highlight评价为“重大进展、重要突破、奇迹、这个领域革命性的成果。。
。”。
审稿：10几个杂志，110篇左右。杂志IF从很低到15不等，有不少杂志排名在Top 0.3%,

过去30天看见好多EB1B的战友被0002和0214 NOID，我也预感不好，今天公司律师告诉
我收到NOID(其实已经过去好几天了），算了下只有20天出头的时间准备材料。
申请的背景如下：
1. PhD，业内大公司R&D Engineer，分析化学背景，偏冷的仪器领域。
2. 一共7篇journal，其中5篇一作。3篇1作和另外2篇不是一作发表在Analytical
Chemistry上（领域top期刊）。
3. 推荐信7封，一封来自导师，一封合作教授，一封公司研发部VP，其他4封是
independent，分别来自美国，英国（2封），瑞典。
4. 提交的时候引用77个，现在89个。
5. 会议oral presentation 4次，poster 1次。
申请的情况：
公司一直用Fragomen的律师，申请过程中感觉水平不行，我自己早期把关了RL（现在看
来是没写好没突出重点）和后期自己按版上的完全重写了PL（自己感觉写的还可以，感
觉IO没看）。
律师的PL claim了4项，只有7页。我后来删减到了3项，扩孔到15页，涵盖很多大家常
用的方式。

刚收到律师的信说他收到了NOID。
我们单位是美国去年第一的医院，只给senior的researcher办EB1B. 律师说这还是第一
次收到NOID，说“ we have never gotten a response like this from a case like

这真是晴天霹雳啊。

加了四封推荐信（都是引用过文章的人），要了几封editor的信证明是领域top的人才
能被邀请审稿，
最主要的还是要挖料挖料挖料（之前不上心 惨痛教训啊筒子们），然后要在推荐信中
体现， 另外最后决定的回信策略是相当于重写了一遍PL， 而没有针对io逐条反驳（因
为可能就是个模版io拿来贴一下吧）
感觉这个0201还算比较公正，也有可能holiday season了，心情比较好^_^

每一次都是noid都是totality上面出问题。
第一次算是条件差。后两次也算条件差不多了。都被noid真的很丧气。不过也算是连续

须证明你的工作outstanding。这一点就多少回到EB1A上去了。你的朋友可能很
outstanding吧。换言之，IO可以因为你不够outstanding直接否决你三年工作经验的事。
NSC和TSC我只是想说，并没有传的那么神乎其神。至少这个区别我咨询的几个美国律师

据说USCIS降低EB1的速度，是为了spill over 名额给07大潮的人。
不知道是不是准确。
根据印度人的网站，我查了一下， 从去年10月到现在，EB1 485总共才批量大约300个左右。总量不降低 反升。
我会根据大家的意见来修改，大家可以畅所欲言，把需要改的东西都发上来，我会综合成搞，给大家
我们需要行动，大家团结一下行吗
如果在同一时间，大家给USCIS的director 发信，我相信是由效果的。 要去争取，不要死等。

计能达到eb1ab及其家属的2倍，而eb1c的abuse正是eb1 backlog的主要原因之一,同时
也间接造成了eb2的排期变长。我们必须要停止h1b和eb1c的滥用，这样我们才不至于每
天担心烙印太多的问题。
我写了一份petition letter, 并且已经发给我uscis的director和本州的两位参议员。
