发帖数: 30 | 2 1. 好消息是，法律规定，如果她能够签H4回来，那么只要能够到美国，她从前的任何
Status都已经clear了。也就是说，不管她以前有没有unlawful的状态与否。她的状态
就是从H4这个合法状态算起。也就是说任何非法移民，只要离开美国，再通过合法签证
到美国，他以前的非法状态在申请绿卡时不必理会。实际情况是，根据的非法时间的长
短，这些非法状态会遭遇1-10年的bar。并且有可能终身被拒签，即使bar的时间已过。
2.好消息2 是，根据245k条款，EB base的绿卡，递交485前，最多可以容许180 days的
unlawful的stay or work。
3. 坏消息是，485 pending期间，很短的时间就回国签H4回来，估计不是用advance
parole进出海关，因为advance parole需要3个月才能下来，楼猪很明显根本没考虑此
问题。如果是这样，她离开美国 wothout advance parole，此情况视为485 abandoned

第一个问题是Part 3. Processing Information
1. Date of Intended Departure
2. Expected Length of Trip (in days)
那个帖子里填的是3个月。大家都是怎么填的？什么时候拿到AP卡是不是和1填的内容相
关？AP卡的有效期是不是和2填的内容相关？
第二个问题是Part 4. Information About Your Proposed Travel
1.a. Purpose of trip
1.b. List of countries you intend to visit
对这两项，能填两个不同的地方么？比如填今年底回中国看父母，然后2017年夏天去法
国旅游么？

上的（这就是combo card，上面写serves as I-512L Advance Parole）。你确定他的
EAD是combo card吗？因为有可能他们给了他一个EAD不是combo card，跟着分别给了他
纸质的AP。 |

不是关于绿卡，而是关于工作签证的，第二部分是关于EB类的绿卡，不过这个法案并没
有增加EB类的绿卡名额，而只是允许提前交I-485(交500美元处理费)和签发有效期为三
年的EAD和AP. 这实际上是个很moderate的改革，可惜当时没有通过。现在把法案贴出
来, 我觉着今年有可能会有议员提相类似的法案:

Prior to your wife departing the U.S., she must obtain her Advanced Parole
card. She should not depart the U.S. on F-1 status prior to the Advanced
Parole being issued or she will be deemed to have abandoned the I-485
petition. If she travels on the Advanced Parole, returning on H-4 status
will not be an issue, even if her status is noted as F-1 in the petition. |

parolee的身份吗？
可是申请学校的助学金，学校不承认，学校拿出一个list, 让移民局选，移民局选了绿
卡pending的选项，没有选parolee, 因此学校就认为我们不是qualified non-citizen
（paroled 一年以上就可以成为qualified non-citizen), 就不能申请助学金。
为这事，我们去了本地的移民局，作infopass，很气愤的事发生了，那个移民官告诉我
们说，I-94上的戳子给盖错了，paroled就当天有效，给一年是不对的。
一头雾水，怎么办，怎么让移民局出具parolee的证明？ |

还有，入关的时候海关人给我解释说我的Stay有效期是一年

Program (参见链接 http://www.cic.gc.ca/english/department/ctp/eligibility.asp ）。而且我和我的朋友在Vancouver转机前都通过了Canadian Border protection的关于有效证件的检查，说明我们是符合了Canadian 的China-Transit-Program规定（China-Transit-Program对于从US到上海，或者从上海到US的规定要求是一样的）。所以Air Canada在上海拒绝我们(我跟另外一个朋友）登机是一个Baseless Wrong Judgement.

。就是尽量保持H1B，尽量不要使用AP或者EAD。

寄出的AP。”你的这句话原文没有出处。没有地方提到HLKV的AP只能将来用。
希望大家多多咨询律师或者律师联盟。
下面是I-131的Instruction。大意是说：HLKV签证不必申请AP，但如果没有AP必须用
HLKV回来。最后一句话是说：如果回美必须有AP或HLKV签证。

Individuals who are not U.S. citizens, do not have valid immigrant visas,
and have pending applications for certain immigration benefits are required
to apply for a travel document and be approved for Advance Parole prior to
leaving the United States in order to avoid termination of their pending
applications.

我并不是纠结renew vs. new applicaiton，只是不太清楚二者在申请程序上有无区别
。现在看来是没区别的。
还想再问一下申请AP所需理由，i131表是这么说的：
